In the case Montgomery v. Louisiana Henry Montgomery was charged with the murder of Charles Hunt. He was sentenced to life in prison without parole. However he was only 17. Henry Montgomery should be sentenced to life in prison without parole because he committed murder. He was willing to kill an innocent man. 58% of states have come to the conclusion that the risk of releasing the murder under the age of 18 has the risk of future victims. Meaning if we let this criminal out he could strike again. The sentences should be based on age. Miller v. Alabama was about a 14 year old and Monomer v. Alabama was about a 17 year old. You can not compare these two ages. 17 is near…
On June 25, 2012, the Supreme Court had ruled that juveniles who committed a crime such as murder, could not be sentenced to life in prison because it is violating the Eighth Amendment's ban on cruel and unusual punishment. In the supreme court decision, I agree that it is harsh and should not be allowed for a minor to serve life in prison, even if murder is committed. The decision is agreeable due to the severe punishment on someone young whose life is ruined over the decision they made. The information on a minor is misleading it masks a juvenile as a brutal killer is society's eyes. These statements should be brought to the people who are disagreeing with the court decision, and prove that these minors do not deserve an adult sentence with life in prison.…
In the article “ On punishment and Teen killers” By Jennifer Jenkins talks about how this teenager has killed a Woman, when she was pregnant which she begged for the life of her unborn child but the teen was eager to feel how it would be to shoot someone and he right there shot her to death. Which now the teenager has been sentenced to three life sentences in prison. He is not the only one dealing with teenage killer crimes but there are about 1,300 cases nationally that have sentenced teenagers as an adult to life in prison. Therefore many people wish to lower down the offender's culpability just because of their age. In canada rarely any teens committed any crimes until 1980 were television had been introduced which affected teens. Many kids…
Once this story had reached the public many statements and opinions started to circle around: Many people felt that a 30 year sentence was too short. They took a life so they should spend the rest of theirs in a cell. The boy’s biological father said that he wanted to kill his ex-partner and that he didn’t know how someone could be so cruel and horrible to such an innocent child. The boy’s biological father said that he wanted to kill his ex-partner and that he didn’t know how someone could be so cruel and horrible to such an innocent child.…
Historically, children have been regarded as constitutionally different from adults. This fact is evident in the way past cases have been decided. Certain juvenile characteristics such as their “ immaturity, impetuosity, and failure to appreciate risks and consequences” illustrates the clear discrepancy between children and adults. Furthermore, the majority contend that instances that call for punishment as severe as life imprisonment without parole will be exceedingly uncommon and rare. Requiring that all juvenile convicted of homicide are sentenced to life in prison without the possibility of parole regardless of age or other mitigating factors violates the principle of proportionality.…
The judgement to try her as an adult was so messed up. It shows you that Criminal Justice System is out to hurt individuals instead of helping them through the situation. When looking at her speaking in court you tell she told the truth because she never changed her statement and/or lost eye contact in the courtroom. This young girl body laugh actually show her remorse for the victim and she didn’t really mean to kill the victim because she wanted to. She really was scared and worried about the victim and she sounds so intgentate and smart that really was in a bad situation. I completely understand that she did something wrong but life wasn’t the answer in this case. Why through away the key when this young girl been through a lot in her life, evidence that clearly show she have psychology disorder and it was genetic that come from generation to generation. Her biological family have psychical disorders and Her mother has Bipolar, suicide thoughts. She has been raped and also wanted to do things to hurt others because they did to her. Her whole family tried of killing thereself. In this case, this young girl should have the life I feel she should have got lesser sentences. I feel the system is all messed up with minors and they need to learn when a juvenile is clearly telling the truth and didn’t mean what she did from the ones that didn’t care…
Many people around the nation have different views on the subject of juvenile justice. Some believe that despite the children's age, they should still be tried as an adult if a serious crime is committed. On the other hand, some believe children should not be tried as adult even if they commit a rather serious crime. I firmly that these children should not be sentenced to life in prison despite the serious crime that they have committed and should have another shot at life when their brain is fully developed.…
Juveniles should be tried as adults depending on the level of the crime. Based on the information in , “On Punishment and Teen Killers ”, Jennifer Jenkins, explains how a teenager killed her younger sister ,which was pregnant with her first child, and her husband If the juvenile knew what they were doing they should be tried as an adult. Juveniles that commit huge crimes should face adult sentencing since they are responsible.…
Juvenile receives crucial punishment, how could you give a twelve year old sentenced to life without possibility of parolo. Now that is just heartless to do something like that to a juvenile. The reason for juvenile being tried as adult is what happened in the 80s and 90s, many juvenile were in gangs and causing tremendous crime making the crime rate raise for the younger generation.…
Juveniles shouldn't get sentenced to life without parole for committing a crime at a young age. A punishment is necessary but, sentenced to life without parole at a young age is devastating. Why should they even continue to live? They are young and deserve a second chance to rehabilitate. All we do is just throw these kids in prison and forget about the. What these kids need is treatment especially, those raised in violet environments. Sometimes they grow up unaware of what's good or bad. It may not be there fault. I'm not stating that they don't deceive a punishment, what the need is a punishment but also the support of a person.…
Juveniles should not be let off easy because it increase that chances of it occurring again because they did not receive the punishment. The consequences of a juvenile's action should not be determined by race, ethnicity, gender and color of skin as well as economic status. We shouldn’t their enablers, we should let know and experience that every single action has it’s consequence. If teens can plan a murder confess it and not feel any remorse they should also be given the proper punishment and face time in prison. I do not think it is wrong, I believe that it is just to trial a juvenile as an…
In 2010, juveniles committed 8% of homicides. (PBS 2014) When it comes to trying juveniles as adults, many people think that this is too harsh of a punishment for young criminals, but others think that they should get what they deserve. There is a famous saying “do the crime, do the time”. Our society tends to think that juveniles do not have the mental, and physical stabilities that adults do. Over the years, our society has changed their views and started treating children/juveniles as young adults. Some people think that juveniles should be given a second chance since they are our children of the future, but others disagree and believe that juveniles know what they are doing and that they should be tried as adults. Each juvenile case can be different and should be treated accordingly looking at the severity of the crime. Depending on the crime and the severity of the crime can depict what kind of punishment a juvenile can face.…
I don’t think there is one juvenile living that is ready to be in a prison environment, it’s not anything that you can train for and I am also concerned about if the juvenile will receive the proper medical and mental health services. But for a juvenile to be on death row is very disturbing. Juveniles are young and juveniles haven’t gotten a chance to explore and actually live their life so this is a sad scenario. I don’t think there is any crime even a homicide or armed robbery is worth putting a juvenile on death row. The judge should have some sympathy and issue out a split sentence before even considering death row for a juvenile. The famous quote “if you can’t do the time don’t do the crime” is very serious but I think the system should be lenient and have some sympathy for…
Although the Supreme Court ruled is as a “cruel and unusual punishment,” the sentence if fair because the convicted committed an act of murder that took away another person’s life. Such an example is Greg Ousley, who purposely murdered his parents and planned the murder days before he committed it (Greg Ousely Is Sorry, 9). Unlike previous scenarios mentioned, Ousley purposely planned for the murder of his parents. Despite the fact that he was still a teenager when he committed the murder, he had an intention to silence his parents and killed both of them in cold blood. This greatly differs from the previous convicted juveniles who accidentally killed their victims. Juveniles that have motives such as Ousley should be convicted as an adult and be sentenced a life in prison because, despite their age, they can think and act like an adult. Because of this, the Supreme Court’s decision of disallowing “teenagers” from “cruel and unusual punishments” should be overturned on certain cases, because, as seen in Ousely, some teenagers are capable and can plan murders beforehand. This not only reveals that certain teenagers can plan beforehand, but that they can think like adults in order to murder someone with…
Juvenile crime is very wide spread within our country. Juveniles commit crimes every day; whether it’s stealing candy from a store or stealing a life. Those who commit such heinous acts such as taking someone’s life should be sentenced to life in prison or in some cases, death. But the question still stands: what if it is an adolescent who murdered somebody, should they be sentenced to life in prison or even sentenced to walk death row? I believe that juveniles should not receive life in prison but rather an evaluation on their mental health to see why they acted in such a way.…
