Or is society as a whole are guilty and to blame for forsaking the future generation? The juvenile offences are skyrocketing at an alarming rate that it is hard to view the graphic and horrific crimes of the juvenile as being anything but civil or delinquent, especially when the juvenile is committing bloody murder.
The primary difference between the juvenile court system and the adult court system is that the juvenile is viewed by the court with more civility and as an delinquent and on the other hand in adult court is it view with criminality. The United States government is based on a checks and balances type system. The three main parts of this system are the executive branch, the legislative branch, and the judicial branch. This judicial system’s job is to uphold the law of the land. Law can be defined as a set of rules or norms of conduct which mandate, proscribe or permit specified relationships among people and organizations, provide methods for ensuring the impartial treatment of such people, and provide punishments for those who do not follow the established rules of conduct (Wikipedia.org, 2005). This is a very wide and all encompassing definition of the law and the governing judicial system. Just like the United States government the judicial system is broken up into different checks, balances, and systems. Two of these main systems are the juvenile justices system and the adult justice system. The obvious difference between these two courts is that the juvenile system is designed to handle youth offenders and the adult system is designed to handle adult offenders. Both of these two systems despite their difference have the same end goal; to administer justice. In the pages to follow we will discuss the big picture of the juvenile justice system, go over a point by point comparison between the juvenile system and the adult system, touch on both the benefits and disadvantages to being tried as a minor in the juvenile court from the perspective of a minor, and review the societal implication of abolishing the juvenile court system.…

This system was set up for those persons who did criminal acts, but who are not yet considered adults. In most states the age for criminal culpability is 18. While the age of being treated as a juvenile in the court system is up to the age of 18, this can depend on the crime. Juveniles can be transferred to the adult court system if the juvenile court waves or relinquishes its jurisdiction. Juvenile law is mainly governed by state laws…

“The only effective way to reduce and prevent juvenile crime is to balance tough enforcement measures with targeted, effective and intervention initiatives.” Juveniles are children and children don’t know any better and obviously make mistakes. They don’t expect to be caught after committing a serious crime. Juveniles brains are not fully developed until they are 25, but young people recognize them as adults at the age of 18. About 25,000 children a year have their cases sent to adult courts instead of being tried in juvenile courts, whose convicted defendants are usually set free by the time they turn 21. Trying juveniles as adults is not beneficial for them. But it also is a crime. And crimes are crimes whether…

In the United States, anyone who is charged for committing a crime before the day of their 18th birthday is considered a juvenile and depending on the severity of the case shall be tried as a juvenile. There are some cases; however, where the juvenile justice system should be harder on the juvenile, but in most cases they should not go to an adult prison. There are most certainly some cases in which the juvenile should face the adult justice system, but for petty instances, a juvenile court will suffice. I find it hard to agree that a juvenile convicted for crimes dealing with drugs, alcohol, traffic violations, etc. should be tried in an adult court to receive punishment; however, I do believe that someone who commits rape, murder, kidnapping, or any other major crimes of the sort should be taken to an adult court. “Old enough to do the crime, old enough to do the time,” is a quote I remember hearing as I was growing up, but I was not taught that it applied to small or minor crimes, but often serious ones involving the harming of another individual. Placing juveniles in adult prisons can cause them to be put in danger, when in reality many of them can be “fixed”…

Over the course of history, children could be tried in court as early as seven years of age. Children are vulnerable to so many different things throughout their young lives. These things involve peer pressure, stress, controlling their emotions, and more. More than likely, juveniles sentence to the death penalty come from homes where they are already physically, mentally, and emotionally abused, low income backgrounds, and other types of unstable environments. Juvenile courts and adult courts are both similar and different in many ways. They’re mainly similar in putting away offenders or giving a punishment. Juvenile courts and adult courts are different in the way that juveniles are not put on trial for committing crimes, but for delinquent actions, and when the delinquent actions are very severe, then they could be considered crimes and the juvenile could be tried as an adult in the adult court system. Also juveniles don’t have the same right to a public trial in front of a jury that adults do. Juvenile courts seem to be more lenient towards their offenders because in their case they are trying to rehabilitate and reform delinquents and then release them into public society. Whereas the purpose of adult court is simply to punish…

Minors should not be tried as adults when convicting a crime because they have not experienced the adult world yet, and they technically don’t know what they are getting themselves into at that age, and state of mind. But they should, however be sentenced to a strict probationary system and do community service to understand what they have done was wrong.…

The juvenile justice system is distinct than the adult justice system in terms of their purpose, the role of the court, the pre-adjudication programs available, the trial procedures, and the sentencing process used. Unlike the adult justice system whose goal is to punish, the priority of the juvenile justice system is to rehabilitate and reform juvenile offenders. Additionally, the court or state has the right and responsibility to act like the parent for a child if the family is unable to do so through the Parens Patriae doctrine. In the juvenile justice system, juvenile offenders are given a hearing, whereas in the adult justice system, adult offenders are given a trial. Juveniles are prosecuted for committing delinquent acts. Adults are prosecuted for committing crimes. In other words, juveniles can be found to be delinquents while adults can be found innocent or guilty. During a hearing,…
