Law and Ethics in Medicine HIPAA gives you rights over your health information, it entitles you to getting copies of your information making sure it’s correct, and to know who has accessed it. HIPAA regulations are enforced with Health Plans, most Health Care Providers, and Health Care Clearinghouses. However, these laws are not required to follow the Privacy and Security Rules for the following, life insurers, employers, worker compensation carriers, some schools and school districts, some state agencies (like child protective services agencies), many law enforcement agencies, and many municipal offices. If believed your rights are being denied or your information isn’t being correctly protected, you can either file a complaint with your health care provider or file a complaint with the U.S. Government. When filing a complaint, you must do so in writing, either on paper or electronically, by mail, fax, or email. The entity or business associate involved must be named and a description of the acts or omission you believe violated the Privacy, Security, or Breach Notification Rules. Filing must be within 180 days of when you became aware of the act or omission being complained of occurrence. There’s a possibility OCR (Office of Civil Rights), may extend the 180 days of “good cause” is shown. Once an Entity (Health Care Provider) discovers a breach (i.e., when the incident involves the impermissible use or disclosure of P.H.I. (Protected Health Information), becomes first known), a notification needs to be sent to the affected individuals without delay and no later than 60 calendar days after the date of the breach (unless requested by law enforcement).
