I don’t think it is in need of being revived. While some people may use parts of the creativity of other’s for things like remixes, they are still in a sense being just as creative themselves while building onto what someone else has created before them. And for every remixed or covered song on Youtube, there are two more videos of original content by creative artists and musicians. I believe creativity breeds creativity in our culture. Music or film trends tend to create new trends or inspire new artists to create new works.…

At issue in the twenty-first century is the trade-off between the necessity of writers, musicians, artists, and movie studios to profit from their work and the free flow of ideas for the public benefit. Movie (and music) industry participants claim that encryption programs are necessary to prevent piracy. Others, however, including the defendants in cases such as Universal City Studios, Inc. v. Corley, 273 F.3d 429 (2d Cir. 2001), argue that the law should at least allow purchasers of movies, music, and books in digital form to make limited copies for fair use.…

Music sampling is a clever way for artist to produce songs that demonstrates their admiration of other artists by integrating part of their music into their own. Music sampling is not new, sampling started in the 1940s when composers and artists would use someone else’s music to create their own piece of music without asking the original artist for permission or giving the proper credit. Due to music sampling, in today’s society we have a variety of music genres. Sampling reconnects many listeners to past events and will allow future artists to be to develop new forms to express themselves by using preexisting ideas to create a new sound.…

Musician Tom Lehrer said “I have always found it interesting… that there are people who regard copyright infringement as a form of flattery.” (n.d.). Although flattery was probably not on the mind of 2 Live Crew when they released “Pretty Woman”, the group’s intent for the song was to be a parody of Roy Orbison and William Dees’s version of “Oh, Pretty Woman” (Deutsch, 1995). The facts and legal reasoning behind this case will be discussed to show how the court reached its decision. In addition, the fair use doctrine will be defined along with how it was applied in this scenario. Lastly, a discussion on Fair Use in regards to why it is important to protect intellectual property, why it is important for society to have access to intellectual property, and a balance between the two.…
Artists have found a variety of ways to rework other pieces to create their own original products. However, only a few ways are recognized as acceptable; mostly, that is through gaining permission to use the copyright materials and crediting the original artist. There are popular instances where copyrights are not followed exactly as intended, though. One such example is DJ Danger Mouse’s underground production, The Grey Album. The Beatles’ self titled album, also known as The White Album, and the a cappella release of Jay-Z’s…
Smashed written by Koren Zailckas is an autobiography that describes the reality of growing up with the hard impact of how much influence alcohol can hold on a person. This is not the typical story about an alcoholic because she does not refer to herself as an alcoholic. She instead, writes about her relationship that she has with alcohol. This story details from her first drink at fourteen years old to her real-life realization after college that this lifestyle choice is not worth all that it is accompanied by. The story follows the theme of a girl growing up in the real world and enduring the different stages of life, however this story is different than your average, “coming of age” novel because it is based solely around the dependence…
During the late 1950’s through the 1960’s, pop art included techniques that were different that the traditional methods of producing art and issues of ownership. Sampling became a technique that was used by artists and Andy Warhol’s artworks impacted popular music. Music sampling was a technique that was used to produce new music and the turntable was used to mix music. Over the years, technology has allowed existing sounds to be transferred from one song to the next with a sampler. In today’s music world, many famous artists including Beyonce, Ed Sheeran, Kanye West, Jay Z., Ariana Grande, Jason Derulo, and other singers use music sampling in their songs as a way and inspiration to express their creativity and expand unique forms of music.…

I disagree with D. Feinman because it is not right at all to take people’s work. The author explained many things that people can do. One of the things he talked about it that people can take the songs remixing them in their own way without telling anybody. This is bad for people who worked hard to write the songs and for the singers who sang the songs. When people change the song and post it on the internet others will stop to listen to the old one and starts to listen to the new one. However, he agreed with Andy Warhol when he used the photomechanical method on his own way. He said, “Not content with copying the style or subjects of others, he used photomechanical methods to put actual reproduction of works into his creations”. This means that people can look up for certain things and change it to…
In his book Making Beats, Joe Schloss builds on existing arguments presented by other scholars and academics and uses them to construct and support his own original argument about sampling. Similarly, in a song such as Eminem’s “Berzerk,” Eminem uses source material to construct his own song with its own unique sound and atmosphere. Although “Berzerk” prominently features a melody from Billy Squier’s “The Stroke”, Eminem utilized this existing tune in a modern way and wove it together with original rhythms and lyrics to create something different (Eminem 2011; Squier, 1984). Eminem’s song, like Schloss’s argument, is new and original; both, however, would not exist without the help of some form of borrowing. In both instances, the source material provided the support and structure necessary for Schloss and Eminem to construct new works. Sharing ideas creates a sort of workspace with material for people to develop new ideas, and this promotes the expansion of any…
Copyright laws were established in the Constitution to "promote science and the useful arts" (Copyright). In the age of digital formats for music, copyright law makes it illegal for bootleggers to commit audio piracy by copying works of music without paying the artist. However, the invention of digital sampling, which allows a musical artist to take sound from a previously recorded work and incorporate it into a new work, has challenged the existing copyright laws. The search for balance between the need to protect artists from audio piracy and the goal of fostering the ability of new artists to draw on previous media has made a good deal of legal controversy within the music business. Laws and court decisions have not established what balance…
