INTRODUCTION:
This case involves suspect Learn being caught by Security Guard Aguilar leaving the store with various items he did not pay for.

I took a series of digital photographs of the recovered items and uploaded them into VeriPic as evidence. Officer Kim responded to my location with Witness Manager Edwin Elias M/H DOB 11/13/68, in the back seat of her patrol vehicle. I had Learn step out of my patrol vehicle and Elias positively identified Learn as the suspect who took the loss without paying. I placed Learn back inside my patrol vehicle and had Elias look at the miscellaneous items I recovered from Learn’s backpack. Elias positively identified the recovered items as items taken from Smart & Final. Officer Kim asked Elias if the store desired prosecution and he said, “Yes.” Officer Kim transported Elias back to 401 N. Fair Oaks Ave. (Smart & Final) and had him read and sign the Statement of Arrest by Private Person form (see attached copy of signed …show more content…
Fair Oaks Ave. (Smart & Final). Upon arrival, I made contact and interviewed witness Security Guard Aguilar and he told me the following in summary. Refer to my body worn camera for further details on Aguilar’s statement.
Aguilar told me around 2:58pm he saw a male Black (suspect Learn) enter the store during business hours with nothing in his hands. Aguilar was alerted by an employee, who said the male Black was in the alcoholic section of the store. Aguilar responded to the alcoholic section and saw the male Black was talking to himself and carrying a bag of cookies, Tazo milk carton, 2 beers, and cheesecake. Aguilar watched the male Black walk past the registers with the items still in his hands. Aguilar watched the male Black leave the store with the items without paying for them. Aguilar told Manager Elias and they both exited the store to confront the male Black. Aguilar and Elias contacted the male Black in front of the store and attempted to retrieve the stolen items. Aguilar told the male Black to give the items back. The male Black refused and said, “I’m not giving you anything back. Call the cops, I don’t care. Don’t touch me.” The male Black proceeded to walk away from them on foot, heading east on Villa St. Elias dialed 911and informed dispatch of the crime. Aguilar had nothing further to

After about an hour and a half, the McCann’s paid for their purchases and proceeded to leave the store.
