The issue which arises in this case is peters concern that he may have unknowingly formed an agreement with Emma for the sale of his car, prior to accepting an offer and selling his car to Andy. He is fearful he may be in breach of contract. The following law(s) apply in this case: invitation to treat, willingness to be bound, recognizing an offer, termination of an offer and acceptance

The plaintiff was refused sale of the advertised goods as it went against the shop's house rules to serve ladies only, which was not indicated on the advertisement. The court found the advertisement to be an offer under certain circumstances, particularly when the actions needed to accept the offer is clear. On march3rd Emma makes an offer on the car, after inspecting it the previous day. Peter does not accept her offer and states wants more for it. He increases the amount in response with a counter offer to Emma. The rule for counter offers is found in the case of (normile v. miller, [1985]), Plaintiffs Normile and Segal both attempted to purchase a piece of real estate from Defendant Miller. Normile first submitted a bid, but Plaintiff responded with a counteroffer and asked to contact him by 5.00pm. The court held that there is not an enforceable contract between Normile and Defendant to purchase the property because of the deadline for acceptance.
A counteroffer acts as a rejection of the original offer and does not contain the terms of the original offer. The counteroffer, like the original offer, must be accepted before it is revoked. This follows with Peter asking Emma to call him back at 6pm. Peters statement is most likely to be deemed a term in the counter offer and Emma's failure to call back before the expiration of the counter offer, means that the counter offer has most likely expired due to lapse of time, and no contract for the car being
