I. INTRODUCTION
What the hell is legal medicine, anyway? Legal medicine is a branch of medicine which deals with the application of medical knowledge to the purposes of law and in the administration of justice. It is the application of basic and clinical, medical and paramedical sciences to elucidate legal matters. What is the legal basis of the inclusion of the subject “Legal Medicine” in the medical school curriculum? Sec. 6 of RA 2382, as amended, provides for the inclusion of Legal Medicine in the medical school curriculum. What is the legal basis of the inclusion of the subject “Legal Medicine” in the law school curriculum? Sec. 5, Rule 138 (Attorneys and Admission to Bar) of the Rules of Court provides for the inclusion of Legal Medicine (referred to as “medical jurisprudence”) in the law school curriculum. What law governs the practice of medicine in the Philippines? The Medical Act of 1959 (RA 2382), as amended, governs the practice of medicine in the Philippines.
II. THE MEDICAL ACT OF 1959
ARTICLE I: Objectives and Implementation
Sec. 1. Objectives. This Act provides for and shall govern (a) the standardization and regulation of medical education; (b) the examination for registration of physicians; and (c) the supervision, control and regulation of the practice of medicine in the Philippines. Sec. 2. Enforcement. For the purpose of implementing the provisions of this Act, there are created the following agencies: (a) the Board of Medical Education under the Department of Education, and (b) the Board of Medical Examiners under the Commissioner of Civil Service. Comment(s): The Board of Medical Examiners is now known as the Board of Medicine and is now under the PRC (Professional Regulation Commission). The PRC in turn was formerly under the Office of the President and currently under the DOLE (Department of Labor and Employment).
