Appendix 1 Introduction
In this assignment I will give a brief explanation of the Irish Court System and Sources of Law and I will explain the roles of the people involved in a Court Case and Court Proceedings.
I will also give a Court report on a criminal case involving the D.P.P. v Waldemar Solowiow and a civil case involving Tesco V Dunnes. The Irish Court System
The courts in Ireland consist of The Supreme Court, The High Court, The Court of Criminal appeal, The Circuit court and the District Court. It originates in the 1922 Constitution which was enacted on the foundation of the Irish Free State. That Constitution provided for the setting up of new courts to replace those which had developed under the British administration. New courts were established in 1924 under the Courts of Justice Act, 1924 which established the legal basis for a Court system.
The Hierarchy of the Courts
Superior Courts The Supreme Court and the High Court were established by the Constitution. The Supreme Court is defined as the Court of Final Appeal, but usually hears appeals only on points of law. Its decisions as to the interpretation of the Constitution and the law are final. The High Court also has authority to interpret the Constitution. It tries the most serious criminal and civil cases, and hears certain appeals from lower courts. When sitting as a criminal court it is called the Central Criminal Court and there is a jury. Lower Courts Beneath the superior courts are the Circuit Court and the District Court. The Circuit Court deals with matters that must be tried before a jury. The District Court deals only with minor matters that may be tried summarily. The
