One punch laws have rapidly changed since the beginning of this year. The one punch is often referred to as coward punch or Assault causing death if it took the victim’s life. The law is under Crimes and Other legislation Amendment (Assault and Intoxication) Bill 2014 and futher changes are to be passed down to an extent this questions the effectiveness the law has in addressing society’s needs.
Earlier this year in January,t here has been a few punch incidents that has caused the victim to be either in a critical condition or death. This conducted immediate law reform on One Punch alcohol laws and the bill was passed by the NSW Government as the lower has approved of the Bill on the 30th January around noon and the Upper house voting in favour shortly before 7PM. In Directing society’s needs, the new legislation under the common law includes new areas in Sydney where bars and clubs are open to new and strict conditions such as 1AM for lockouts and 3AM for last drinks at pubs and clubs. Measures include 8 year mandatory minum sentencing for alcohol and drug fuelled assaults that end in death which is written in Section 25B of Assault Causing Death by Intoxication-Minimum mandatory Setencing, which is under Schedule 1 of crimes act 1900 no 40. A Few other measures the government has implemented to make our streets safer in society are on the spot fines for street disturbance, disorderly behaviour, from $200-$1100, if refusing a move on order from the police, maximum penalties are increased by two years if there are aggravating factors.
