Introduction
This paper will take a closer look at how Identify theft takes place. In such way the author will further make clear the rights of an accused that is involved in identity theft. Additionally, the author will review state and federal laws and any early changes in the laws over the recent years (AIU, 2016). The author will answer the questions below:

Nonetheless, there are a few more components to identity theft that is not associated with financial damage. For instance, medical identity theft is a growing problem. This is also a form of insurance fraud, involving an individual receiving medical care using the stolen name and birth date, and in some cases stolen insurance policy information. This is considered to be a crime under (Tennessee Code Annotated Section.). Many times these types of crimes are just as devastating. We are in the age of technology and information; the law continuously ends up trying to catch up. In 1998 the Identity Theft and Assumption Deterrence Act was passed. This act strengthened criminal laws on identity theft. What was started as a protection of theft of credit cards and social security numbers, is now protecting all information over the world wide web and all electronic account transactions from theft. I belief that the law will have to make adjustments in the near future (Department of Justice, 2015).
Federal and State Identity theft laws Consequently, there is federal protection against identity theft, 18 U.S. Code §1028. Describing each act and sentencing structure in the eight subsections to follow. This covers most financial crimes, but other areas of fraud are covered as well. In addition, the Tennessee penal Code 39-14-150 covers identity theft victim’s rights. This code details identity theft trafficking, seizure/judicial forfeiture, criminal impersonation and using a false identification .
