Introduction
The parties to this dispute herein before this Court are FIMCO
Management Sdn. Bhd. (hereinafter referred to as “the Company”) and Yap Cho Heeon (hereinafter referred to as “the Claimant”). The dispute is with reference to Section 20 of the Industrial Relations Act
1967 whereby the Claimant contends and considers himself to be constructively dismissed from the service of the Company with effect from 31 May 2000.
This matter was heard by Y.A. Datin Yeoh Wee Siam from
16 October 2007 until 3 December 2008. She heard the evidence of the Claimant and CLW-2 and also partly the cross-examination of
COW-1.
