C) college student drugged at a party
- Yes, the college student could try to plea for the insanity defense, however, would not be admitted into a psychiatric ward and would be proven mentally fit. The reason why is because even if the drug was in their system during the time the murder was committed after a couple of hours the drug would lose its effect and leave the person body making them mentally fit. The only thing the drugged college student can do is state to the court during the time of the murder they didn’t have control of their body at that moment and hopefully the jury would charge them with first-degree murder or not guilty due to being drugged and not being in control of one’s body but insanity isn’t an option.
D) husband killing his wife in a rage
- Yes, the husband who killed his wife because he was in a fit of rage could try to plea for the insanity defense, however, would not be admitted into a psychiatric ward and would be proven mentally fit.
The reason why is because after the fit of rage was over the husband was once again able to regain his insanity. During the moment of the husband rage who killed his wife, he allowed his anger to take over his mind and he committed a crime that he would later regret. The insanity defense case would not work in his favor because if a psychiatrist was about to diagnose the husband as a none dangerous person to their self or to another person than the judge would throw out that defines because the husband never shown any type of mental disorders before the crime was
committed.
