The MARPOL Convention of IMO was subjected to extensive changes in July, 2011. Annex V of MARPOL that deals with prevention of pollution to marine environment by garbage disposed form ships underwent a lot of changes. These amendments have entered into force from Jan 1st, 2013 (Resolution MEPC.201 (62), July 2011).These amendments have caused considerable confusion to the maritime community.
The MEPC (Marine Environment Protection Committee) of IMO, has also published recommendations for implementing these changes (Resolution MEPC 219(63), March 2012).
The revised MARPOL Annex V regulations considers Cargo residues from bulk cargo carriers as garbage. Before the amendments, cargo residues from bulk carriers were not considered as Garbage. The ship operators were at liberty to clean their cargo holds of cargo residue and dispose the wash water and residue into the sea irrespective of the cargo which was carried (Rogers et al, March 2013).
What is “Cargo Residue”? The revised Annex defines Cargo residues as the remnants of any cargo (not covered by other MARPOL annexes) which stay on the deck and cargo holds after loading or unloading operations have been completed. This includes excess or spillage and those cargo particles entrained in wash water. The cargo dust which remains on the deck after sweeping and the
