Jarrah, as an Iraqi National, needed a valid Airport transit Visa (ATV) to board Flight 815 because the flight included a two-hour layover in Paris, France. (R.6) Mr. Jarrah's ATV was valid through November 3, 2009, Flight 815 however, was scheduled to arrive in France on France November 4, 2009. (R.6) According to Oceanic boarding policies as of January 2, 1996 passengers are required to have a valid Airport Transit Visa (ATV) when landed in Belgium, France, Germany Luxembourg, the Netherlands, Portugal and Spain. (R. 2) Following Oceanic Airlines guidelines and Oceanic employee informed Mr. Jarrah that he could not board the plane. (R.6) When acting in capacity as a diplomat, Mr. Jarrah would be exempt from the ATV requirement, regardless of his nationality. (R.6) When the oceanic employees denied Mr. Jarrah's boarding, he presented his diplomatic passport to the Oceanic employee and explained the diplomatic exemption.
