Ms. Patt's Case Summary
Ms. Patt’s Complaint is similarly conclusory. Ms. Patt’s complaint alleges that Will Walters refused to rent a unit in Defendant Donner’s apartment complex based on discrimination against families with children.

However, Ms. Patt’s Complaint simply states that she was discriminated against but failed to provide the factual basis concerning Will Walter’s discrimination against her, similarly to Ashcroft.

Furthermore, Ms. Patt’s Complaint states that Defendant Donner was in violation of the Fair Housing Act; yet failed to provide the rule of law in order for her corresponding allegations to meet the plausibility standard.

I spoke with Craig Ribbens, who is one of the insureds’ long-time tenants. Mr. Ribbens was cooperative and offered to help in any way that he could. However, the information that he provided was not very beneficial to our defense. The house that the plaintiffs rented is one of five that the insureds own in a small compound. Mr. Ribbens informed us that he did not know the plaintiffs, but heard from other tenants that they moved out because there was mold throughout their house. Although he never saw the mold, and has seen none in the house that he rents, he occasionally smells mold in his house in the past.…

The hearing today will only take a few minutes with any luck. I will be able to make a decision before you leave.” He explained since Mr. Cassidy’s house was old and in need of repairs, the people of Howardsville had filed a petition to demolish it. As a result, Mr. Cassidy requested, we declare his house a historical landmark. “Since the house is over a hundred years old and he has lived there since birth, we will consider the petition.” Picking up another document, he stared at it. “Louise Anderson filed a protest stating the house is in need of repair. You have refused to allow her club to have the repairs done. She is requesting we have the house demolished. I’ll decide if her claim is legitimate.” The officer removed his glasses, looked at the ceiling for several minutes before he put them back on and read the documents several times. Laying his glasses on the desk, he asked, “Would you like a cup of coffee?” When they refused, he poured himself a cup. “Mrs. Anderson, it’s reasonable that you would like to see the house demolished, but considering Mr. Cassidy’s age. It would only be right to declare his home a historical landmark and allow him to stay in the house, but, he’ll be responsible for the repairs.” Louise asked, “May I say something?” “Sure, what’s on your mind?” Standing up, she addressed him, “Thank you, I’m the president of the Women’s Club, we spoke with several contractors who agree it’s unsafe for him to live in that house. Although, we offered to pay for the repairs, he was adamant that he had no use for charity for healthy people capable of working, and there was nothing wrong with his house, it was just old. I’d like him to move out at once.” “Mr. Cassidy, do you want to say anything?” “Yes, Sir,” he said. “My home is…

The Plaintiff can state that she was discriminated based on gender and seek damages due to a breach of contract through the contract exception under the employment at will doctrine (p. 415). In regards to the wrongful termination on the basis sexual discrimination, the plaintiff can claim this because the male employee that replaced Elaine had less experience and education. Although the employer is an at-will employer it is does not need to have employment contracts. The plaintiff can argue that an implied-in-fact contract (p. 416) was enacted between them due to the job offer letter and falls under the contract exception to the doctrine. This implied contract was established with the job offer letter which stated “an annual salary of $30,000” and where Elaine has “great career opportunities”. The annual salary, which at least classifies the contract for a year, and then also the use of the term career, both imply a long term commitment from the company. Also, the plaintiff can argue that she never received an evaluation…
