NSPS Subpart Kb Case
This permitting action will not change the applicability of any NSPS subpart, except for NSPS Subpart Kb. It was determined that the definition of "process tanks" under NSPS Subpart Kb was not considered under previous permitting actions for Husker Ag. The 190 proof ethanol tank and the 200 proof ethanol tank are exempt from NSPS Subpart Kb, because they do not meet the definition under that subpart for "process tanks".
