Simple Assault/ Family Violence
On 06-05-2017 at approximately 1637 hrs, I was dispatched to 105 E. 4th Avenue for report of a disturbance taking place. Upon arrival, I made contact with 2 complainants, identified as Ashley Saucedo (TX-DL # 23686268), Lois Wilson (TX-DL # 15802552). During my investigation the following events occurred. Ashley advised, her sister Amber had come over to the residence and began to fight with her, by punching her several times while on the floor. She mentioned that her aunt Wilson was able to separate the two by pulling the two apart during the altercation. In the event Ashley mentioned she was struck in the left eye, I could barely see any bruising at the time. while attempting to separate the two. I took a statement from Ashley and Wilson via video statement describing the events that had taken place. I was unable to locate her sister Amber, due to her departing the residence prior to my arrival. I took photographs of the injuries and noted areas of swelling and bruises. Ashley and Wilson requested to pursue assault charges against amber. During the investigation Ashley and Wilson declined medical evaluation. I advised the two, I would attempt to locate and speak with Amber to gather her side of the incident. I departed the location without incident.
The following day on 06-06-2017 at approximately 0800 hrs, Amber Perry (TX-DL # 27561168) arrived at the police department to give a voluntary statement on facts that occurred the prior day at 105 E.
4th Avenue. Perry advised, I went over to see my sister Ashley and Aunt Lois, I went over to drop off movies. I was upset because there was some smack talking about me and my family, I confronted Ashley, by rushing in the house, she attempted to swing at me and I grabbed her hair. Ashley grabbed mine and we both went down to the floor together, my aunt Lois pulled us off of each other and told me to leave, so I did. Perry advised she never struck Ashley with any type of fist, but only grabbed her hair. I immediately noticed discrepancies in all of the statements and asked Perry if she would return to Lois's residence with me. Perry agreed, I spoke with Lois and asked her what had really taken place that day, she advised, Amber came over and the two had gotten into an argument. They both grabbed each others hair and fell to the ground, I was trying to separate them and in the process I injured myself against the wall. Lois advised she never observed Perry swing or strike Ashley with a closed
fist.
I advised Lois that she and Ashley lied to me during the video interview yesterday, I informed them that it is false report to a police officer. Lois apologized and advised she did not want to pursue charges against Perry because it was a misunderstanding. Perry and Lois apologized to each other, I departed the location and advised Ashley over public service to meet with me in reference to the statement made yesterday. Ashley arrived at the police department, where I informed Ashley that I have discovered some discrepancies in the statements taken. I informed Ashley that if she was deceptive in the video statement she gave me, she could face false report to police officer charges. I informed Ashley that I could issue a citation to her and her sister for simple assault class c, or file false report charges for being deceptive during a statement to a police officer. Ashley advised she did not want to pursue prosecution against her sister and instead would reconcile their differences. I informed Ashley that I will file and retain this case within the police department and if needed until the statue of limitations expire. She departed the location without incident.
