Nussbaum The Use And Abuse Of Philosophy In Legal Education Summary
In Martha C. Nussbaum’s The Use and Abuse of Philosophy in Legal Education, she covers topics ranging from Socrates and his role in Greek government to Aristotle’s claims that philosophy plays a major role in the education of our judicial officials. She begins the article with an event from Socrates’ life. Socrates goes up to a leader of the time and asks him for some definitions of basic legal thoughts. The leader proves to be unable to answer any of Socrates’ questions, showing his lack of knowledge and thought. Socrates goes on to compare himself to a fly and on the rear of a horse that is there to wake it, with the horse representing the Greek government. She goes on to begin introducing the main points of the article, the first one being …show more content…
When it comes to sexuality, she explains that many judges make decisions based on the sexuality of those involved; because of this, their thoughts can be blocked by their feelings about certain sexualitys and attractions. Her last subpoint of quality of life discusses how the judicial system should measure the quality of life of those passing through. The next point of methodological and epistemological questions discusses how philosophers find the answers to difficult questions. The next session is about specific policy questions and how philosophers who use applied philosophy are more knowledgeable than some others. The next two sections of legal institutions and practices and wonder discuss how philosophy and deep thought should be used more often in the sentencing and punishment of criminals. She gives an example of a philosopher who was teaching classes at a prestigious law school. She taught her law classes as she would a philosophy class, trying to get them to engage in meaningful thought and solve practical

    In Athens Greece, there was a very wise man considered by the Athenians who lived through the Periclean age (around 400 BC) and his name was Socrates. For most of his life time Socrates was a highly well respected philosopher; who loved teaching philosophy of life to anyone who listen in the street of Athens. All was dandy until his friend Chaerephon had told him that “He went to Delphi at one time and ventured to ask the oracle – as I say, gentlemen, don create a disturbance – he asked if any man was wiser than I, and the Phythian replied that no one was wiser” (Plato, p 26). During Socrates crusade of trying to find who was the wise man alive. Socrates oversteps his boundary and decries powerful men’s. Now these powerful men (Lycons, Meletus, and Anytus) started to dislike Socrates and his teaching; claiming that Socrates teaching is corrupting the minds of the Athenian youth and that he also did not believed in the Greek gods, so Socrates seventy years of age was put on trial. Near the king-archon’s court, Euthyphro was astonished to see Socrates at the court house. Now Socrates finds this very interesting because Euthyphro, a professional priest highly respected by “authorities” (those who wants to get rid of Socrates) is at the court house to prosecute his father for murder. Now for Socrates to have a clear knowledge of the definition of what Piety is? Which he could use to help defend himself, because prosecutors know and think highly of Euthyphro “an expert on ritual and on piety generally” (Plato, p 2) was for Euthyphro to explain why he was prosecuting his father for murder. Only then Socrates could equivalent between himself and Euthyphro; who citizens’ highly respect, bringing him respect, and freedom.     Any argument relies upon some fundamental agreement about the issue being discussed. However great the divide in opinion may be, there must exist at least some similarity in the participants’ manner of viewing the issue if a solution is ever to be reached. Book One of Plato’s Republic features a disagreement between Socrates and Thrasymachus about the nature of justice. The disaccord between their views of the subject is extremely pronounced, but there are certain underlying agreements which guide the course of the debate. One way to evaluate the validity of the arguments involved is to examine whether the assumptions at the root of the argument are in accord with this common ground. By my reading of the dialogue, Socrates’ reply to the first part of Thrasymachus’ definition of justice rests safely upon this common ground, whereas his answer to Thrasymachus’ second definition moves away from this mutually acceptable base, and is injured as a result. In exploring this topic, I intend to examine briefly Thrasymachus’ two-part definition of justice. For each of these parts I will evaluate one Socratic response and discuss it from the perspective of the “craftsman analogy” – an analogy which is initially used by common consent, but which Socrates adapts until its original usage almost disappears.…

    Socrates first addressed the old accusations, which he described as prejudices implanted in the minds of the jurors, by many, when the jurors were quite young. Believing that it would be more difficult to remove such prejudices, Socrates first attempted to refute the old preconceived ideas about him (18b-e).
