They believed that this doctrine has no place in the interpretation of the First Amendment. Meanwhile, Justice Douglas argues that how this doctrine applied was weak and perverted. The Court’s Per Curiam held that Ohio law violated Brandenburg’s free speech right. The court evaluated this by mean of the "directed at inciting or producing imminent lawless action" and "likely to incite or produce such action”. With that said, the failure to do this rendered the law as overly broad; and is in violation of the…
In Schenck v. United States, the Supreme Court keyed the famous “clear and present danger” test to determine when a state could constitutionally limit an individual's free speech, under the first amendment. In finalizing the conviction of a man accused with disturbing the peace by handing out provocative flyers to draftees of the war, the Supreme Court came to the conclusion that in certain ways, words can create a “clear and present danger” in a way that Congress may constitutionally disallow. While the decision has since been overturned, Schenck is still a major point in creating context-based balancing tests used in reviewing Freedom of Speech challenges.…

Knowing your audience is a critical component of public speaking. Understanding the group of people who are receiving the message is second in importance only to the message itself. A poor understanding of your audience can lead to a poor delivery of the information that you need to get across. Speaking from the perspective of the announcing the incident, one must note the different roles and people in the audience. The families of the miners and the employees of the company must receive the…

As much as I hate to agree with the courts decision, I have to be fair. Brandenburg had broadly made a statement that they would take action if the government does not. To many of us, it does seem like a threat that he is going to do something, and we all know what the Ku Klux Klan has done. However, Brandenburg was clearly expressing his right given to him by the First Amendment. That right he chose to express was clearly his right to freedom of speech. With regards to clear and present danger, we have to think of the time in which this happened. If we knew then what we do now, Brandenburg would have rotted in jail. It was unclear that anything was going to happen at the time, and it did not present any real danger because there…
