People v. Goetz, 1986

Facts:
On December 22, 1984, Darryl Cabey, James Ramseur, Troy Canty and Barry Allen were on the same subway car with Bernhard Goetz. Canty approached Goetz and demanded five dollars. At this point, Goetz stood up, pulled out an unlicensed .38 pistol and fired four shots at the four boys, establishing a “pattern of fire.” None of the boys displayed a weapon or otherwise threatened Goetz. Goetz fled the scene but turned himself into police days later. He claimed he was carrying the weapon because he had previously been mugged.
Charge:
Goetz was originally charged with criminal possession of a weapon in the third and fourth degrees. After the prosecutor appealed, he was indicted by a grand jury and charged with four counts of attempted murder and assault in addition to the weapons charges.

    In the People v. Caballero case, the 8th amendment was being denied when 16 year old Graham was served with “…a minimum of 110 years before becoming parole eligible” (People v. Caballero).     Philip "Kip" Kinkel was born on August 30, 1982 in Springfield Oregon(TruTv). Growing up Kip had an interest in firearms from an early age(PBS). At first his father did not like the idea, but later he enrolled him into a gun safety course and bought him a .22 caliber Ruger long rifle and eventually a 9 mm Glock handgun when he was 15(PBS). During an interview with Newsweek Kip said that his psychologist told his father to "let Kip have the guns, for it will be a good outlet(PBS)." However, the outlet he eventually used them for was anger and revenge. It all started on May 20, 1998 when Kip brought a loaded, stolen handgun to school(NYT,Nov11). It was a .32 Beretta pistol loaded with 9 rounds(TruTv). A friend of Kip’s, Korey Ewert, had stolen the pistol from the father of one of his friends, and sold it to Kip for $110(TruTv). When the owner of the gun, Scott Keeney, noticed that his firearm was missing he immediately called the police and reported it(TruTv). While talking with the police Mr. Keeney gave the names of several high school students that he believed might have been involved in stealing his handgun(TruTv). However, even though Kip 's name was not on the list the school called him to the office to see if he knew anything(PBS).     On June 28, 1972, James Richardson awaiting the subway train which would take him to work. He was stopped and ordered to “put up your hands, and get against the wall”. These directions were given by an off duty Transit Authority patrolman named John Skagen. Skagen’s actions seem unprovoked and unnecessary. After a short tussle the two men exchanged shots and Richardson fled the scene on foot. Two other officers that were on the main street above the subway station were made aware of what was transpiring below and rushed to the scene. As they approached the entrance of the station, Richardson who was fleeing the scene ran directly into one of the officers. The officer noticing Richardson’s wound attempted to stop Richardson and engaged in pursuit. The other officer continued down into the subway and witnesses Skagen who was in civilian clothes brandishing his gun. At that moment the officer emptied his gun into Skagen who was able to let off one round prior to the officer shooting him. Richardson was later apprehended and taken to the emergency room for his wounds. His gun was also retrieved. Skagen was rushed to the same hospital emergency room where he was pronounced dead.…
