Philip B. Royster Case
On Tuesday, 01/03/207, at 1442 hours, I, Deputy Stacy Stark #1815 was dispatched to take a telephone report for a theft. I spoke to the victim, Philip B. Royster (M/W, DOB: 05/04/1961). Royster stated someone stole numerous tools from his shop trailers parked on Boat Dock Rd. I requested to meet Royster in person at the location to take the report, he agreed.

I left the Jackson County Sheriff’s Office and drove to Boat Dock Rd, Pomona, Jackson County, Illinois. I located Royster at the Abbey Ridge Brewery, 24 Brewster Valley Alto Pass, Illinois. Royster stated his trailers were parked across the road in a muddy area. Royster drove him and me across the road to the scene in his utility vehicle. The area across the street was owned by the Abbey Ridge Brewery. Royster was building a structure on the property for the Abbey Ridge Brewery. On the property there was the beginning of a structure surrounded by gravel and dirt, parked vehicles, large pile of scrap metal, a smoker, a pile of brush, some type of tractor implement, and Royster’s three box trailers. Royster drove us to the front of his box trailers. There were muddy vehicle tracks surrounding the box

The tools are not business owned. Royster stated the tools have been collected throughout his years. Royster stated he contacted his insurance company that morning about the stolen tools and the insurance company denied coverage.

Royster did not suspect any specific person, but believed it was someone who knew he had his tools stored on the Abbey Ridge Brewery property. In Royster’s opinion, he believed it was someone who knew him because particular items were taken, when so many other tools could have been taken. Royster stated none of his concrete construction tools were missing. Royster stated the tools that were taken, were tools that were easily grabbed and not large heavy weight tools.

The garage belongs to another because it is a neighbor’s garage. The court in State v. Nelson interpreted a dwelling to include an outbuilding close to the dwelling, if it is capable of being fenced in. The garage is probably capable of being fenced in, it is close to the house because it is 6 feet from the house, and it belongs to a neighbor; therefore, the second element is probably met. The act of taking the beer evidences a probable intent to commit a crime when he entered. Therefore, all the elements of the statute are met, and there is probably sufficient evidence to support a charge of…

The City of Albany decided to upgrade a fleet of repair trucks in order to respond to pothole fixing. ACME manufactured a cab and chassis of a truck that was then sold to Keefer Motors. Keefer Motors sold the truck unchanged to the City of Albany. No discussion by ACME or Keefer Motors had taken place with the City as to what the city would do with the truck. Susan’s Truck Equipment was contracted by the city to add a dump bed and hoist and the truck was modified and redelivered to the City of Albany; the truck was accepted and put into immediate use. Sarah and Emma are city employees and Sarah was injured when Emma backed up the pothole truck over her. Sarah was seriously injured and is suing ACME, Keefer Motors and Susan’s Truck Equipment, arguing that the truck was defective and unreasonably dangerous because the defendants did not advise the City of Albany to install a back-up alarm and they failed to install a back-up alarm.…

One afternoon, after lunch my family and I were sitting around relaxing when the doorbell rang. I got up to answer the door and realized it was a detective from the Sheriff’s office. As I invited him in, I felt apprehensive at the reason for his visit. When I asked him the reason for his visit, he stated that he believed our home had been burglarized. My family and I were completely unaware and started looking around as he asked if anything was missing. Everything seemed to be accounted for inside of the house so he asked us to check the garage. Upon entering the garage, I noticed that one of the fuel tanks was missing from my boat and that two of my rods and reels were missing as well. I was extremely angry because one of them belonged to my grandfather. The detective asked us to view photographs of some stolen items to try to identify our missing property. While viewing these I was able to identify my missing fishing equipment, which was later returned, but my tank was not among the items recovered.…
