Healthcare systems should be controlled by each state because it is easier to talk to a state representative, then to speak to someone at the Federal Government. According to NBC, states have a history of being able to quickly help health insurance customers. Going off of this, If the Government does not do a great job of controlling healthcare, it would be easy for healthcare providers to use “marketing abuse”. Giving the Government power over healthcare would cause a lot of complications. For example, Blue Cross Blue Shield says that Government control of healthcare will cause confusion and problems between the Federal Government and state healthcare regulators. Also, Because states might try different ways of controlling healthcare, there is a better chance that it would be overall better for the citizens.
There are many modern examples of court cases that were state v. Federal Government. One of the biggest modern court cases that had to do with Federal v. state government was Obergefell v. Hodges. The outcome of this court case said that same sex marriage was legal and that states could not say otherwise. In this instance the Federal Government overruled the states. Another example is in the case of National Federation of Independent Business v. Kathleen Sebelius, Secretary of Health and Human Services.
