Considering that these flaws can work in two ways, it's hard to conduct a decent search on someone with the time it takes to get a warrant. before (but got rid of them afterward) gets searched afterward, it makes it look as though the policeman/policewoman searching the suspect brought fake evidence to get the warrant. The same thing happens if the police were fooled into believing that an innocent person has some type of drugs on him/her. They search an innocent person which then embarrasses the person who got searched and the policeman/policewoman who searched the subject. It makes it seem as though the policeman/woman had falsely accused the subject for an unknown reason.
The police also get into trouble if they search someone without a warrant. It is possible for them to lose their jobs if they do this because it would be unconstitutional. In a way, it wouldn't be fair for the suspect to get randomly searched one day out of the blue. For example, if a mom who had been thought to have drugs was walking through a park with her children, it wouldn't be fair to her to get searched in front of her children, especially without a warrant or proper reason. Now if the police do have a proper reason and a warrant, I’m sure the subject would still protest the search, but it's more understandable than just getting randomly searched.
Having the fourth amendment to me is almost a way to keep the peace.
Having people live in fear of the police because they might get searched for no reason is not living freely. Then of course there’s the fear that would come along with not needing a warrant. People would be afraid to walk by policemen/policewoman because they might get searched. A policemen could basically walk up to a random citizen and say “I’m going to search you.” and the person would have to get searched without their consent. It’s definitely a good thing that we have the fourth amendment, but there are some modifications that can be made to it to make it more reliable. Being able to search a person because they blatantly have drugs is on modification that should be added. If the policeman finds something, then they did their job. If they don’t they could be punished for falsely accusing the suspect. However, this is only the idea of a thirteen-year-old boy. The fourth amendment does keep people from fearing the police around them now though. Maybe I’m just weird for having negative feelings towards the fourth amendment, but I just have a different way of thinking about
it.
