Racism And Court Cases
"Sir, you cannot sit here, you are of color". What a sad world we live in where people are not allowed to have the right to do something solely based on their race. In this essay I begin to enlighten you on two particular cases where two cases of racism were sent to court and these cases changed colored people's privileges. These cases were: Brown v Board of Education and Plessy v. Ferguson. I cover key points on the majority decision with both cases and laws being mended with.

    Homer Plessy was arrested in 1982 in Louisiana for sitting in a first class train car due to Plessy being a light skin color he was able to buy a first class train ticket and pass for being white. Although Plessy was born one-eighth black and seven-eighths white, according to the “Louisiana law enacted in 1990”, he was considered as black, and he was supposed to sit in the “colored” car.     Board of Education of Topeka which reversed the Plessy v. Ferguson decision of 1896. This changed America in that “separate but equal” was no longer a law. The NAACP or The National Association for the Advancement of Colored People, called for a reconsideration of the Plessy v. Ferguson case and won. The case “raised a variety of legal issues on appeal, the most common one was that separate school systems for blacks and whites were inherently unequal, and thus violate the "equal protection clause" of the Fourteenth Amendment to the U.S. Constitution” (United States Courts, 1). The case had decided that the main problem with the previous case was that the education systems for public schools were completely unfair. The white schools were given and used twice as much money to fund the schools compared to the “separate but equal” black schools. The completely changed the civil rights movement. Also the whole law was just completely unfair and not “separate but equal” because nothing was equal. This made everyone, at least by law, equal to each other. Not that everyone immediately followed this law once it became true but, this was a huge step in making everyone equal once again. Many forms of resistance appeared during and after these cases. Oliver Brown had went to NAACP(National Association for the Advancement of Colored People) to fight to get Linda in the white school. The NAACP hired lawyers to fight for dark skin children all around the United States to be able to go to the same schools as white children. The 14 Amendment was violated by this case.
