AN ACT DEFINING CYBERCRIME, PROVIDING FOR THE PREVENTION, INVESTIGATION, SUPPRESSION AND THE IMPOSITION OF PENALTIES THEREFOR AND FOR OTHER PURPOSES
As information technology has been developing so rapidly, it affects almost all Filipino’s nowadays. In today’s world, the internet has been the most useful technology which helps us not only in our daily lives, but also our personal and professional lives developments. For education purposes, the internet is widely used to gather information or in doing research. Even for business personnel, electronic commerce has played an important role in transacting business. The internet has also served to be useful in maintaining contacts with friends, relatives, and with people around the world. Let us also not forget that the internet is useful in providing with most of the entertainment these days may it be through games, movies, songs, networking conferences or social media.
Just like any normal interaction through the use of the internet, it is also a haven for people who commit certain crimes such as pornography, defamation, fraud, computer hacking or misuse. To set an example, a computer misuse was demonstrated when a Filipino hacker created a virus “Love Bug” which destroyed data in 45 million computers and caused damaged worth $10 billion. However, the offender was never punished because the Philippine’s at that time had no law criminalizing computer misuse.
In other countries such as the United States, there were several laws passed to protect the public of computer misuse. Thus, global pressure is now on the Philippine government to stop such abuse. This prompted the government to pass a law addressing specifically those criminal activities carried out by means of computers or the internet. Hence, the passage of Republic Act 10175 “AN ACT DEFINING CYBERCRIME, PROVIDING FOR THE PREVENTION, INVESTIGATION, SUPPRESSION AND THE IMPOSITION OF PENALTIES THEREFOR AND FOR OTHER PURPOSES”.
