Chapter 9 Problem 10 Schumacher took over his parents business at their request, built a new home on their land, installed a well, and bought equipment for the business all with his own funds. There was a verbal agreement that Schumacher would be allowed to manage the business for life and a large parcel of land would be given to him when his first parent died. When the parents decided to sell the Inn and adjoining property, Schumacher sued. He lost, because in Minnesota, the agreement had to be in writing and his was an oral agreement. The question is does Schumacher have a valid claim for unjust enrichment? Yes, the parents benefitted from the new home and all the improvements to the parents land, such as, the new home, the well, and all the business equipment.
Chapter 10 Problem 6 An offer for sale of a parcel of land adjacent to ST. Nicholas Greek Orthodox Church was sent by letter from Pernal to the church and also to White Chapel Memorial Association Park Perpetual Care Trust. The church sent back an acceptance offer that made changes to the original offer. Pernal acknowledged receipt of the offer and sent a letter to both parties that the original offer still stood. The church sued Pernal for breach of contract saying their offer was an enforceable contract. The question is will the church win? No, because the church did not accept the original offer. It changed the original offer and that change was not accepted by Pernal so

In my opinion Nichols, was in violation of Garelli Wong’s claim because of the disclosure agreement he had signed while under their employ. Contracts are binding and that is the smoking gun, and that being the case Nichols was in direct violation of that contract, for this reason alone the courts should have found in favor of Garelli Wong, Inc.…

This paper examines the concept of tax avoidance and evasion. The two terms have different meanings and they all contribute to the decrease in government revenue. The government raises most of its income through taxation. However, defaulters greatly contribute to a substantial decrease in the overall government income. There are very many ways in which people carry out taxation malpractices. Some of them have established a loophole in the legal system that gives them a chance to evade taxes without facing the risk of being prosecuted. This has greatly encouraged the act. On the other hand, government taxation officials and agencies also contribute towards tax avoidance and evasion. Officials encourage tax avoidance by taking bribes and letting some people and business walk without paying their taxes. On the other hand, there have been complaints about the PSI contributing to tax evasion and avoidance. Over the years the government has worked tirelessly towards ensuring that incidents of tax evasion and avoidance are greatly reduced if not eliminated. Introduction of the Alternative Minimum Tax is aimed at making sure that nobody avoids taxation completely. The United States Tax Disclosure Regulations are aimed at enhancing transparency and increasing promptness when it comes to dealing with tax defaulters. However, according to the study there is still more that needs to be done to deal with tax avoidance and evasion.…

The history of human race has also been a history of drug use. Since earliest times, herbs, roots, bark, leaves and plants have been used to relieve pain and help control disease. In and of itself, the use of drugs does not constitute an evil; drugs, properly administered, have been a medical blessing. Unfortunately, certain drugs also initially produce enticing side-effects, such as a feeling of euphoria, a sense of ”feeling good”, elation serenity and power. What began as something of a recreational activity evolved in time into a problem of dependence and abuse.…

The concept is to develop an approach based on wavelet transform for the evaluation of harmonic contents of power system waveforms. This new algorithmic approach can simultaneously identify all harmonics including integer, non-integer and sub-harmonics. This algorithm presents features that characterize the power quality disturbances from recorded voltage waveforms using wavelet transform. The discrete wavelet transform has been used to detect and analyze power quality disturbances. The disturbances of interest include sag, swell, outage and transient. Waveforms at strategic points can be obtained for analysis, which includes different power quality disturbances. The wavelet has been chosen to perform feature extraction. The outputs of the feature extraction are the wavelet coefficients representing the power quality disturbance signal. Wavelet coefficients at different levels reveal the time localizing information about the variation of the signal. A wavelet packet transform (WPT) method is introduced as a useful tool for detecting, classifying and quantifying the RMS of testing waveform and harmonic ratio value. The proposed approach can measure the distribution of the RMS of testing waveform with respect to individual frequency bands directly from the wavelet transform coefficients. The harmonic ratio value relative to basic frequency band can be calculated as well. The method is evaluated by its application to both analytical waveform and actual testing waveform data.…
