Reserve for Replacement Guidelines
RESERVE FOR REPLACEMENT GUIDELINES
REGION VIII - DENVER
JANUARY 2009

Throughout the history of the Department of Housing & Urban Development (HUD) Assisted Housing, the housing industry has complained with some validity, that HUD has not been consistent in its treatment of Reserve for Replacement requests. This will always be somewhat of a problem because of the many different programs, managers, owners, properties, and Project Managers (PM’s) involved. Each situation is unique and some flexibility is allowed and necessary to handle situations in a responsible manner.

This statement is an attempt to define standard requirements for submission of Reserve for Replacement requests. A PM may require more documentation for some properties, but unless otherwise notified, submissions meeting the stated requirements will be considered complete. The Reserve for Replacement requirement is included in the Regulatory Agreements and/or Housing Assistance Payment (HAP) contracts in order to encourage long-term planning and upkeep of HUD Insured or Section 8 subsidized projects. The Reserve for Replacement account is intended to help pay the cost of repairs to and/or replacement of building systems and components.

As we all know, government and industry are now making a concerted effort to be Green - to help conserve energy and resources. We are soliciting your help in reporting some details of that effort at your property by using the newly revised request forms. We can then track how well the energy conscious owners and managers in our Region are moving toward this important and laudable concept. Please do help us with the small effort and minimal information you find added to this package. We all eventually benefit! And, let your PM know if you have questions.

By entering the lease agreement, NeedsSpace (the lessee) becomes legally and contractually responsible for performing general repair and maintenance on the leased premises. Assuming that the lessee is required to make deposits to financially protect the lessor concerning the maintenance obligation by setting up a reserve, the guidance in ASC 840-10-05-9A through 840-10-05-9C states that the maintenance reserve shall be recognized as a deposit asset and reimbursed later when the required repair and maintenance is completed by the lessee. However, the provision in the lease agreement does not call upon the lessee to make deposits but simply requires the lessee to perform repair and maintenance on the leased premises.…

I intend to address the Building Manager in my Justification Report on ways the building can be a ”green” building and have less impact on the environment. The purpose of this report is to introduce new products that can be used throughout the building that are environmentally friendly such as the types of cleaning materials that the maintenance crew uses, types of paper products used, and building materials used on improvements. I also plan to address implementing a recycle program in the building which will assist employees that are interested in becoming more environmentally friendly. I will also look into implementing a “green” roof which will…

An increase in population in Boulder County increases the demand for affordable housing. This is an opportunity that is open for LHA as they continue to do grow and development their organization. The increased threat of a growing population and lack of affordable housing is an opportunity for the organization to find potential funding sources to expand their portfolio. Their new project is due to break ground next month. This is a 62 unit affordable housing for seniors. Flood victims will have priority on the waitlist for this property, due to the fact that the majority of the funding for this project came from a state flood recovery program. The lease will be terminated at the end of the 10 year term and NeedsSpace will not be given the option to renew. The lease agreement specifies that the lessee may have to perform certain tasks at the cost of the lessee when the lease term concludes. In this, our sixth annual State of Green Business report, we’ve made some significant changes — not just in the look and feel of the document you’re reading, but in its content. First and foremost, we’ve partnered with Trucost, a leading research firm focusing on natural capital and sustainability metrics, to revamp the indicators by which we assess progress by the private sector in addressing global environmental challenges. In the spirit of continuous improvement, we scrapped the set of metrics we’d used for the previous five reports in favor of a more comprehensive and robust set that is global in scope. They cover companies’ natural capital costs, their supply-chain impacts, various measurements of transparency and disclosure, and other things. Unchanged is our Top Trends section, which looks at where the world of sustainable business is headed — the leading indicators of future progress. Our efforts mirror those of the business world we reflect: a work in progress. I hope you find insight and inspiration from this year’s report, and look forward to your feedback.…
