In the death of Oscar Grant police officer, Mehserle claimed he mistakenly picks up the gun and shot Grant in the back while he is on the ground. The crime officer Mehserle committed created an emotional stress within the family and the communities he serves. The criminal justice system failed to address the harm caused by Officer Mehserle. According to Zehr (The Little Book of Restorative Justice), in the three pillars of restorative justice, restorative justice focuses on harm committed by the offender. He explained that our legal system, with its focus on rules and laws and its view that the states are the victim, often loses sight of this reality. (32).
