Robin Mason Case Studies
Robin Mason is a 35-year-old, who lives in Kansas whose Father, Thomas Shaw, 58 years old was in an auto accident on October 22, 2016 he was then hospitalized for 3 weeks and released to go home. He spent 2.5 weeks at home and then had trouble breathing, went to the hospital and died shortly thereafter. I talked to Robin who is his daughter on May 2nd. She lives in Kansas she is 35. I told her both under wrongful death and med mal statute that if he had no surviving spouse and she was the only child, being 35 years old, there wouldn’t really be a case, but she said that she had two step brothers, Austin and Ryan who were 17 and 23 and since their both under 25 there would be a case. She says that she has a good relationship with them. The …show more content…
He was stopped and pulled out to take a left onto South Florida Avenue headed towards Mulberry and a truck t-boned him so it sounds like he has some fault. I don’t know if the pick-up truck has some fault; maybe they were speeding. She is going to try to get a traffic crash report. She also thinks there is malpractice because they did not put an IVC filter in. I said well had he had any prior clotting problems and she said no, I said it’s probably not protocol for an IVC filter to be put into a patient that had no prior history. She said that she has a cousin that is an emergency room doctor who looked at the chart and said that they did something wrong by releasing him and I’m not sure I understood her story, but I would need to drill Ben a little more with her there, but he seemed to think they should have released the father without some anti-clotting medication and/or a filter. I told her that we would refer the med mal to Hogan & Frick so when I get back from Omaha I need to get with Kelli to discuss this referral. Also, when I get back from Omaha, hopefully the second week in May they’ll bring the traffic accident report so I can see if there potentially some exposure for the actual accident; if there are witnesses that saw the truck speeding or something like
