Role and Functions of Law
Melvin (2011) stated, “Accepted generic definition of the law is a body of rules of action or conduct prescribed by controlling authority, and having legal binding force” (p.4). Law in our society gives the people duties, obligations, and rights to live by. Without these laws that where put into our constitution the wealthy, the powerful, and those with the most influence would win all arguments. The United States Constitution is the structure that gives function to our law; which is based on providing structure for the federal government, providing powers to the 3 branches of the government, and giving protections to the people of the United States from wrongful government treatment.
The function and role of law has played a big part in the growth of our nation. There are 4 primary sources of law in the United States that regulate business and individuals. These are constitutional law, statutory law, common law, and administrative law. The primary sources of law cover all aspects and can be used in combination with each other to cover areas that one may not pertain too. The laws in place in society are there to protect the people of America. They ensure the wellbeing of the citizens; give guidelines for all to follow, and to punish those who do not abide by those laws set by our government.
Law has an important role in business. It states how we run our businesses, taxation, protection laws from other businesses, regulations that must be followed and to punish those who do not obey or try to bend the rules their way. These laws not only help the businesses, but it is also there to protect the employees from the businesses themselves.
