Should Louise Serrate Cashed The Check Before Donald Lovekamptracted?
1.Should Louise Serrate cashed the check before Donald Lovekamp expired.
I think Lousie Serrate should cashed that check at the time she received it. Donald Lovekamp specifically told her, that belongs to her, because she returned after a divorce to stay with him. He was specific about his wish and made clear that she can cash the check if something would have happened to him. I am not sure if that was a smart decision. In case of death, she would not have any access to the bank account to cash the check. I may be overt thinking it, but I wonder if he did it in purpose because he knew, that she would not be able to cash it.
2.Does the debts of record or promissory estoppel apply in this case. Explain.
