Solomon Tuigamala was a resident of Morton’s Crossing Nursing Home. He had grown increasingly unsteady on his feet and in January of 2011 fell as he walked to the dining room for dinner. Kaye Black, a registered nurse on duty at the facility, observed his fall. She took a photo of him with her phone as he lay sprawled on the ground. She then moved to help him up and noticed he was dazed. She was in a rush to get the residents into dinner on time and so did not document the fall.     On December 28, 2014; Rachel Melacon and Allen Coats gave birth to Olivia Coats. Unfortunately the doctor, who delivered her baby girl, by using forceps against the young couple’s wishes, caused unfixable injuries to the newborn. The couple puts blame for the death of their five-day old baby girl, Olivia Coats. However even though she requested to have a C- section, due to the size of the baby, Dr. George T. Backardjiev shut the idea down. Dr. Backardjiev told Rachel that it would leave a scar afterwards. He ended up using the forceps to deliver her baby girl. Dr. Backardjiev struggled with the forceps, “he even put his foot on the bed” to try and pull the baby out. “Dr. Backardjiev was turning and twisting, and she would never come out, he put the forceps one way and the other; when he touched the top and the side of the skull, we heard a pop, like clay cracking in pottery and heard her skull crush.” The medical staff told the couple their baby was alive; then Olivia was quickly transferred to “Children’s Memorial Harmann Hospital” in Houston Texas, it was at that hospital that they were informed that their daughter had suffered several fractures to her skull and spine; then on January 2nd Olivia Coats died. Angie coats told ABC News “we’re not mad at the hospital, this not their fault. It is one man’s fault, we only want justice for Olivia; we want the person responsible, which is the doctor. We don’t want the hospital being shunned.” The parents plan to sue Dr. Backardjiev for the death of their baby girl. The hospital administration and independent medical staff leadership are all committed in taking all necessary actions in understanding why this happened. The Houston Chronicle reports that the parents of Olivia Coats started a campaign to ban the use of forceps during delivery called “The Olivia Law.” The couple also started a fundraiser on Go Fund Me to raise awareness about the use of forceps explaining how damaging they can be, so far the…

    The case against SSC Pueblo Belmont Operating Company, LLC d/b/a Belmont Lodge Health Care Center, et al on behalf of resident James Edmond Sharon. Mr. James Sharon has been diagnosed with dementia and mental retardation. He has been living at Belmont Lodge Health Care Center in Pueblo since 2011. His sister filed the lawsuit on his behalf in 2013, stating that the nursing home did not treat her brother with respect and dignity. During Mr. James Sharon’s stay at Belmont Lodge Health Care Center, he suffered from bedsores on his ankles and penis so severe that they caused an infection down to his bone. (“3.3 million Verdict, Nursing Home Neglect,” n.d.) Other instances of neglect include Hyperkalemia multiple types of urinary tract infection, skin tears, poor hygiene, dehydration, skin abrasions, being permanently confined to the fetal position due to contractures of his lower and upper extremities. Along with physical neglect, Mr. Sharon suffered from emotional trauma and anguish from his miss treatment at Belmont Lodge Health Care Center. Vital accounts from a former employee, the Director of Nursing, could add some insight on the prior state inspections and the shortage of staff members. In the case, accounts were given by Miss Franz, caregivers and employees about the low levels of quality of care provided by the nursing home. A jury found SSC Pueblo Belmont Operating Company, LLC d/b/a Belmont Lodge Health Care Center, et al was ordered to pay the Mr. Sharon and his sister $3.3 million.
