Some of the stipulations are that T.O has to provide a copy of her settlement agreement to her employer’s. She has employment requirements, employment restrictions, drug screening as well as calling into a call center and continuing education. T.O is not allowed to work in any other state without written permission from the State Board of Nursing. This nurse broke the Nursing practice act was broke according to Section 335.066.1 which states, “Use or unlawful possession of any controlled substance, as defined in chapter 195, or alcoholic beverage to an extent that such use impairs a person's ability to perform the work of any profession licensed.” There is several different parts that were violated but some of them are also, “Violation of the drug laws or rules and regulations of this state, any other state or the federal government.” I think that due to the nature of it dealing with patient’s lives she should be reprimanded. This female is a registered professional nurse. M.B. had applied for a travel nurse position with Med Solutions. On April 17, 2014 she submitted a sample for pre-employment drug test. The test results were confirmed positive for marijuana and tramadol. M.B. did not have a prescription for or a lawful reason to possess, marijuana and tramadol. She did admit to using marijuana and that she further chose to take tramadol for neck pain which she did not have a prescription for. She further stated that she would have got a prescription from her doctor for the tramadol, but did not think it was necessary. M.B. constitutes misconduct, unethical conduct and unprofessional conduct in duties as a nurse and consititues violation of a professional trust or confidence in accordance to 335.066.1. M.B.’s license was put on probation for a period of 5 years.
