The ball is now in Trump's court. Previously, Trump suggested …show more content…
a list of 21 potential nominees. Not surprisingly, all were judicial conservatives. To the Republican Party, this is an opportunity for Trump to "prove" himself. Trump has the option to either appoint a moderate candidate or a die-hard conservative. If Trump decides to select a staunch conservative for review, he will undoubtedly hear from many Republican officials that he cannot be trusted (Liptak).
With the new dynamic of the Supreme Court, Trump is under optimal conditions to appoint and solidify his first nominee (Barnes) Although Democrats will likely try to filibuster Trump's attempts, Republicans will counteract that option for Supreme Court justices, just as Democrats did for other judicial nominations when their party controlled the Senate.
Not only will Trump's Supreme Court rule on new legislation, but they will most definitely review old pieces of legislation that were widely opposed by the Republican Party.
For instance, the Affordable Care Act and immigration reform will likely disappear under a President Trump and a Republican-controlled Congress (Barnes).
Many speculate that Trump will have the opportunity to appoint not one, but three justices as many get ready to retire. Justices Ruth Bader Ginsburg and Stephen G. Breyer, are 83 and 78, respectively. Both are liberal and help balance the current composition of the Supreme Court. In addition, Justice Anthony M. Kennedy, who is 80, also help balance the Supreme Court (Barnes). If those three retire, which is likely, then Trump appoint more justices. However, if they stay, then the make up will remain slightly more balanced.
One decision, among many others such as same-sex marriage, that we will likely see overruled is Roe v. Wade, a decision that expanded reproductive rights for women. “President-elect Trump has publicly pledged to overturn Roe and promised punishment for the one in three American women who will have an abortion in her lifetime,” said Nancy Northup, president of the Center for Reproductive Rights. She was referring to Roe v. Wade
(Barnes).
Newly-elected President Donald Trump has a lot of power in his hands. While many fear the return of a red-dominated country, many celebrate the end of the Obama-era. Appointing new justices will change the political landscape of the Country further; a complete right-turn from Obama's presidency.
