As the states weren't a cohesive entity at this point, Washington wouldn't have had any standing to issue such an order. The British, however, did offer slaves freedom if they found in the British army. Another gross depiction was the British burning the church down with quite a few people inside. The person who ordered this, Colonel Tavington, was based off of Colonel Banastre Tarleton. While he was a violent person, he was not as violent as the movie depicted him to be.
