Re: Territorial and maritime dispute (Nicaragua v. Colombia)
Mr. Tomka
Here is the summary of the court case Nicaragua v. Colombia. The report includes the submission date, the review of the previous court decision, and the objection of the applicant country in which case is Nicaragua.
On December 6, 2001 the territorial and maritime dispute between Nicaragua and Colombia was brought to the table. Nicaragua, a Central American country, did not agree with a treaty made on the year 1928. The International Court of Justice, the main judicial element of the United Nations, made the 1928 Barcenas-EsguerraTreaty for the countries of Colombia, a South American Country, and Nicaragua. The Treaty of 1928 specified the sovereignty of each country. Nicaragua was granted control over the Mosquito Coast and the Corn Island. On the other hand, Colombia was granted power over the Islands of San Andres, Providencia and Santa Catalina. In addition, the International Court of Justice and Nicaragua recognized sovereignty to Colombia over the maritime feature of the Archipelago of San Andres. However, the Intentional Court of Justice did not take in consideration the 1928 Treaty because it cannot be appealed. But the Court does have jurisdiction over the maritime territorial demarcation between the two countries seems it was not resolve in the 1928 Treaty. The maritime dispute includes the Continental shelf, Cays, and maritime boundaries around the islands.
