1. Introduction

1.1. Focus and structure of the study

Efficient insurance markets are an essential basis for the transition countries in Central and Eastern Europe to achieve integration into the global economy and sustainable strong economic growth. With their capacity, capital and know-how, global insurers play a major role in the establishment of an efficient insurance sector. In conjunction with the forces of global consolidation, current advances in information technology and the potential of e-business mark the beginning of a veritable efficiency revolution in the insurance industry.

    Due to globalization, multinational insurance companies could more convenient than before to develop their insurance services in the US. Busse (2003) points out that foreign direct investments(FDI) have a dramatically growth in 1980s and the total outflow increase to $225 billion in 1990s. The average growth rate of the foreign direct investment is recorded in 34% between 1980s and 1990s. The country's life insurance segment registered a decrease in written premiums at a compound annual growth rate (CAGR) of -1.9% during the review period (2008-2012).     The need for insurance regulation arose in England from the collapse of large insurance companies in 1870 that required the financial assistance of the state. Similarly, in the Commonwealth Caribbean, lack of or poor regulation has seen fluctuation in rates, liquidity and insolvency crises, and even bankruptcies of insurance companies that required government intervention. This had caused loss of state funds, severe effects on policyholders, and financial instability in states such as Jamaica, Barbados, the Bahamas, and Trinidad and Tobago in the mid-1990s, that affected the Gross Domestic Product (GDP), increased public sector debt, and slowed economic growth. As such, insurance regulation has necessitated the legal framework of insurance (and regulation) legislation, to fill in the gaps that arise from the Common Law and to formally establish the stance of the legal system on insurance issues.
