The Negligence In The Part Of The Negligence (NMDOT)
I strongly believe negligence in the part of the NMDOT and their associates are the direct cause of the loss of life of my father (Leo Sr.). The NMDOT owes the public a safe and clear lane of travel for pedestrians and traffic, as well as to provide the public a safe and clear lane of travel. The NMDOT breached this duty, and the breach of duty was a direct and proximate cause of the death of Leo Griego Sr. The DOT failed to use due care and caution with safety and concern for both workers and the public when setting up the construction zone. They failed to confirm in advance that any construction or utility vehicles were parked in a safe area and clear area from traffic. The DOT Failed to warn any person utilizing safety personnel.     1. What were the legal issues in this case? This case is based around the laws and regulations of OSHA. OSHA is an Occupational Safety and Health Act that has been put into place to ensure the safety of employees while on the job. These regulations are put into place to help reduce the number of on the job injuries and death. In this case, Williams Construction was put under investigation after a trench collapse, which resulted in the death of one employee and a serious injury in another. After the investigation Williams was charged with four OSHA violations that all resulted in expensive fines. The issues that arose from the investigation included; the failure to instruct employees and managers on how to recognize and avoid hazardous work conditions, the failure to ensure that employees did not have to travel more than twenty five feet to a safe zone, the failure to have a “competent person” that was specifically trained in trench safety and the final violation was the failure to make sure that the walls of the evocation were either sloped or supported. It is the belief of OSHA that if these regulations were followed that this tragic accident could have been avoided. The legal issue here is whether or not the courts and the construction company itself should up hold the violations of specific OSHA standards.…

    Sadly, Delaware has had recent safety issues regarding pedestrians. The last three years have seen an increase in pedestrian accidents mostly due to drunk driving. Drivers in a hurry contribute in a large part to this predicament as well. Most pedestrian accidents occur in parking lots from unsafe maneuvers. Government officials are trying to cut down on this by enforcing simple safety laws. But the truth of the matter does not come down to statistics if you are one of the unfortunate victims of a pedestrian accident. The medical treatments alone can be overwhelmingly expensive and painful as the victim tries to piece together what they can from the damages. There is also emotionally scarring that can not simply be healed with a single doctor visit. These victims and their families deserve justice. A citation from the police will not help the victim get the compensation to pay the needed medical bills and will help in no way to cover any earnings lost from the incident.…
