INCIDENT REPORT

To: The Proprietor cc: Social Services Inspector cc: Health Authority Inspector

Introduction

The purpose of this report is to analyse the causes of the incidents which lead up to, and resulted in, the death of a resident at your home, Mrs X. The report will further draw conclusions from the incident, and will make several recommendations to assist in the prevention of such an incident occurring again in the future.

Account of the incident

Mrs X was an elderly resident who suffered from osteoporosis – a condition which causes the bones to become fragile and brittle.

On the day in question, it appears that a Care Assistant employed by yourself, had cause to restrain Mrs X, and did so by “pulling her shoulder”.

Each one is detailed as follows:

1. On said occasion, it was reported that Mrs X was poking a fellow resident with a stick. This behaviour was deemed to be inappropriate, and Mrs X was restrained by a Care Assistant, who “… pulled her shoulder”.

2. It has been reported that it is common practice in the home for care staff to use physical means, to restrain or redirect residents, however none of the care assistants appear to have received any training in this regard.

3. It is not clear whether or not there were any senior staff, or supervisors, present when the incident occurred.

4. The care assistant made a verbal report of the incident to yourself as Proprietor.

5. A written report was subsequently prepared by yourself, and in it there was a suggestion that the care assistant lost his temper with the resident. This suggestion was subsequently denied by the care assistant, and it is unclear whether or not the care assistant had seen, and was given an opportunity to discuss, the contents of the report.

Social Services should be able to assist with the provision of a copy of their guidelines for good practice on the use of restraint in residential care for adults.

• It is further suggested that you prepare your own guidelines which can be displayed in staff areas and distributed to staff.

This should be an integral part of all future staff training and retraining/refresher programmes.

Staff Supervision (Obs. 3)

• It is recommended that a staffing review is carried out to ensure that junior and/or inexperienced staff are supervised by a senior member of staff at all times.

• It should also be pointed out that as proprietor, you have a duty of care to familiarise yourself with the day-to-day activities of staff (and residents), as you may be held accountable for them.

(This point should be reiterated due to the fact that (as pointed out in Observation 2), physical restraint is viewed as “common practice” in the daily running of the home, despite the fact that this is contrary to the home’s regulations.)

Incident Reporting (Obs. 4, 5, 6)

• It is recommended that a full review of incident reporting procedures are carried

    When working in the care industry whether that is with the elderly, mental health or children it becomes apparent that you as an individual become empowered by virtue of being primary care for that specific individual hence being an influential figure in any individual’s life recovery and rehabilitation. Due to this factor we have had many horrific incidents which have involved individuals in a position of power and whom have abused this trust and disregarded legislation, policy and procedure to continually systematically abuse service users in a vulnerable position. It is no secret that this has happened and still continues today within places of care. This is the purpose of the new legislative law updated and reviewed to combat and eliminate such barbaric behaviours displayed by so called supportive staff members in supposedly places of secure safe environments. The purpose of legislative law is to filter new and reform existing legislation through to the relevant policies and procedures within specific places of work. So to summarise the purpose of legislation in terms of managing difficult behaviours is that it functions to safe guard the vulnerability of service users in places of care which predominantly gets feed down through governing bodies to the policies and procedures file within the office within your place of work. It can be looked upon as a code of good practice with regards how to deal with vulnerable adults whom display challenging behaviours within places of care. When working within such an environment it is almost expected to receive challenging behaviour due to the different backgrounds and diagnosis the service users have so it would not be acceptable to react within such a way as you would when away from the unit due to the very essence of the clientele we deal with.     If an issue of challenging behaviour occurs within the Home, staff should try techniques to calm the situation to prevent any further disruption and try to identify any triggers. These techniques may include music therapy, relaxation therapy, complementary therapies and multi-sensory environments. Staff should receive training on these areas and techniques so that if a situation does arise, they're equipped with information and confidence to handle the issues without any further implications arising. If these are successful, the Care Plan must be updated immediately and this information must be passed over to the senior in charge or the General Manager so that it can be passed on to other appropriate members of staff. This will then provide others with the right tools to prevent a situation or to help manage it if one does arise again. The Care plan must be reviewed and updated every time an incident occurs. Restraint can be used as a way to manage challenging behaviour however this should always be a last resort and only if the danger to the service user outweighs the effect of losing their freedom. If restraint is used too frequently or for inadequate reasoning, it can damage a person’s mental and physical well-being; subsequently causing them to become more dependant, can increase the risk of pressure sores, incontinence and loss of dignity. If restraint is going to be used as a last resort, the senior in charge or the General Manager must be informed and must be in charge of the situation at hand. There should be clear instructions of what’s going to happen, to the staff and the resident to avoid further distress and not provoke further action from the service user.     On Thursday in my placement I was asked to assist Mrs M with her lunch. Mrs M is 90 years old and has dementia. She has barriers to her communication due to her dementia and physically she can’t walk without support. The two care workers, Mrs X and Mrs Z were to escort Mrs M through to the dining area using a wheelchair. The both put an arm through her armpits and put her on the wheelchair before wheeling her away.
