The Winterbourne View Case
The Winterbourne View Case.

The Winterbourne View hospital abuse occurred at Winterbourne View, a private hospital, owned and operated by Castlebeck. Local social services and the Care Quality Commission had received various warnings but the mistreatment continued. One senior nurse reported his concerns to the management at Winterbourne View and to CQC, but his complaint was not taken up.
The public funded hospital has been shut down as a result of the abuse that took place. The undercover footage aired in BBC Panorama presented staff continuously abusing patients in various occasions and with different methods (restraining under chair, cold showers, poured mouthwash into patient`s eyes, pulling hair, leaving patients shaking, depressed, unable to speak for themselves). One of the victims, Simon Tovey, was seen being repeatedly assaulted and mentally abused by the care workers.
The CQC did a nationwide check on facilities owned by the same company, Castlebeck Care – as a result three more institutions have been closed. The CQC reported a "systemic failure to protect people or to investigate allegations of abuse" and said that Castlebeck Care had "misled" the health watchdog. The CQC also inspected 132 similar institutions and a Serious Case Review was commissioned – some of the roughly ten local and national enquiries were carried out to examine what went wrong.
Eleven people plead guilty to criminal offences of neglect or abuse as a result of evidence from Undercover Care and six of them were jailed. Immediately after the eleventh person pleaded guilty, the Serious Case Review was published, revealing hundreds of previous incidents at the hospital and missed

But you do need report this in my case I would report to my senior, nurse, and manger and if I still wasn’t satisfied then I would report this on to social services, safeguarding and CQC. I would make my report in written and date this and keep a copy for evidence. If the report was against an employee or family I would ensure in the meantime that the victim was in a safe environment.…

Winterbourne View in Bristol was featured on Panorama after an undercover reporter revealed the abuse that was taking place in the private hospital for vulnerable adults with learning disabilities and autism. Patients were physically and psychologically abused, threatened, slapped, tormented and bullied on a regular basis. Patients were not treated with dignity and respect or protected from harm. They had no quality of care and were not included in any decisions about the care they received. Patients suffered institutional abuse, had no choice of when to go to bed or to get up in the morning, they were humiliated and belittled, assaulted and unnecessary and illegally restrained. The members of staff lacked training, were not properly supervised, used incorrect manual handling techniques, failed to comply with regulations, recorded inaccurate documentation as to why, when and how restraint had been used, including injuries made through using illegal restraints. (Restraint should only ever be used to prevent patients from harming themselves or others, and should always be a last resort for the minimum amount of time). Staff neglected patients by failing to take steps to provide a safe and secure environment for them.…

After the recordings were shown on BBC one the eleven care workers admitted to 38 different charges of abuse and neglect, six were jailed between six months to two years while the other five were on suspended sentences, the CQC said it was misjudgement that the concerns had not been investigated.…

This case has many similarities of the Michael Shine Case. Staff nurse Bernadette Sullivan was a whistleblower who stayed true to the ethic of patient care and disclosed Dr. Shine’s shocking malpractice. Recent enquires into problem cases like these have brought to light, the importance of taking stock of what is to be learned from these incidents. As nurses, we are bound by legislation for one main purpose- public/patient protection. To fulfil our duty of care, we must continue to act as patient advocate.…
