While traveling eastbound on West Ridge Rd approaching Cline Ave in Griffith
Indiana, I heard Highland Officers dispatched to the area of Cline and Ridge Rd in reference to a possible intoxicated driver traveling eastbound on Ridge Rd in a black Chevrolet Avalanche approaching Cline Ave. As I was going towards that area, I observed a black Avalanche traveling east in the 300 block of west Ridge
Rd. I then observed a vehicle behind that vehicle with the driver waving her arms out the window, as I slowed my fully marked squad car, the female driver started yelling "that's him" while pointing at the black Avalanche.

I then turned my vehicle around to position my squad car behind the offending vehicle. As I turned around, I observed the black

Ridgeway to impound the vehicle.

Once on station, I asked Lopez if he had been drinking any alcohol today. Lopez then advised "I'm drunk". I then asked Lopez to submit to standard field sobriety test. Lopez shrugged his shoulders up and down as he starred at me.

I then administered the following tests:

HGN Lopez was given instructions several times. Lopez was unable to touch my finger with his at the beginning stages of the test. Lopez then moved his head along with my finger after being asked to follow with his eyes and eyes only and not to move his head. Lopez moved his head from side to side, swayed, displayed lack of smooth pursuit, Nystagmus prior to the onset of 45 degrees and distinct and sustained Nystagmus at maximum deviation.

Lopez was then unable to complete any more standard field sobriety tests.

I then read Lopez Indiana Implied Consent in front of Ofc Beck #70, a certified operator. Lopez shook his head back and forth after reading him Indiana Implied
Consent indicating he refused to take any chemical breath test. Lopez again shrugged his shoulders and stated "I'm drunk".

Lopez was then advised he was under arrest for operating while
