Titina Loizidou Case Study
The applicant, Mrs. Titina Loizidou, grew up in Kyrenia in northern Cyprus. She is a Cypriot national, and a Cypriot citizen. In 1972 she married and moved to Nicosia with her husband. Mrs. Titina Loizidou claims that she is the legal owner of plots of land nos. 4609, 4610, 4618, 4619, 4748, 4884, 5002, 5004, 5386 and 5390 in Kyrenia, and she claims that since 20 July 1974 when the Turkish army occupied the northern Cyprus she has been prevented and also is still prevented by Turkish forces to gain access his properties which is mentioned above, and enjoy his property rights. On 19 March 1989, Mrs. Titina Loizidou joined a march which organized by a group of Greek Cypriot women under the name of “Women Walk Home” movement in the village of Lymbia (The village, Lymbia situates near the Turkish village of …show more content…

After the six months the Court gave its judgment about the case of Mrs. Titina Loizidou. The Court decided to reject the Turkey side’s claim that because of Article 50 there is no official right of applicant to just satisfaction. In contrast, said that Turkey government has to compensate pecuniary and non-pecuniary damage and legal costs and expenses.
Because of pecuniary damage which is about applicant Mrs. Titina Loizidou’s economic and financial damage emerged as the result of violation of her property rights by Turkey troops, the court decided she have to compensate for the amount of CYP 300,000 by the Turkish government.
Because of Non-pecuniary damage which is about compensation of Mrs. Titina Loizidou’s undesirable feelings and harm of moral values, the Court decided that the respondent has to pay for the amount of CYP

    The case that was present in 16.5 is that a breach of contract by Ptarmigan Investment Company who had contracted Gunderson’s, Inc. to construct a golf course for them. After just a third of the work had been completed, Ptarmigan Investment Company ran out of funds to cater for the rest of the project. Therefore, they would not be in a position to pay for the remaining two thirds of the work. Gunderson’s, Inc. has sued the company in a bid to recover the lost profits which if granted would be given to them as damages. The question presented is whether Gunderson’s, Inc. can recover the lost profits as damages. It is evident that the investment company has gone against its agreement with the contractor. Ptarmigan Investment Company has rendered inferior performance of its obligations under the contract. In an unprecedented turn of events, they are unable to pay the contractor for their services. Although the work was yet to be completed, the contractor had anticipated a certain amount of profit. Therefore, they are justified under the law to claim compensation from the breaching party. Gunderson, Inc. can receive damages in form of monetary compensation. This is one of the methods used to remedy contract breaches. Compensatory damages are awarded in the event that a breach of contract has led to a loss of a bargain. In so doing it places the non-breaching party in the same position it would have been had the contract been fully performed with regard to the benefits accrued. In this case, payment to the contractor was estimated at $1,294,129 and payment had already been made for a third of the work. The sum of money owed to restore the bargain made is $ 867,066, which would ensure that the contractor has earned their full profits. Compensation for loss or damage caused by breach of contract.- When a contract has been broken, the party who suffers by such breach is entitled to receive, from the party who has broken the contract, compensation for any loss or damage caused to him thereby, which naturally arose in the usual course of things from such breach, or which the parties knew, when they made the contract, to be likely to result from the breach of it.     Facts: In 1965 a Contract of Sales Agent was entered by the Association of Anglo-American Tobacco Corporation with Andres Lao. Lao was to sell cigarettes manufactured and shipped by the Corporation to his address in Tacloban, and he would remit the sales proceeds. Lao would receive commission for those sold, with a monthly salary and operational allowance. In 1968 Lao’s attention was called to his enormous accounts and the difficulty in obtaining a tally despite his avowal of regular remittance of collections. In 1969 it was established that his liability amounted to P525,053. Also, the Corp. discovered that Lao was engaged in a construction business and suspecting that he diverted the sale proceeds to such business, it gave a demand letter for payment of his obligations. It also found that contrary to his allegations, he did not have a huge collectible from customers and nothing was due to the Corporation. From then on, the Corp. no longer sent him shipments. In 1970, Andres, Jose and Tomas Lao brought a complaint for accounting and damages against the Corp.. The court ordered both to undergo a court supervised accounting but also ordered the Corporation to pay the Lao’s actual loss of earnings, moral damages, exemplary damages, atty. fees and cost of suit. Later the court gave a supplemental decision dismissing Lao’s claim of overpayment. The Corp. and the Lao’s appealed. The CA found the Corp. liable for actual damages of loss of earnings, moral damages and exemplary damages. It also ordered the Corp. to pay the claim of overpayment by Lao.
