While conducting the area check, I was advised by Walmart LP Officer, Marion Edwards, that a male subject who had been previously trespassed was inside of the store.
Edwards pointed to the subject and stated "that's him, he was trespassed last year." Edwards further advised me that the subject was an ex-employee that was caught stealing merchandise. However, Walmart did not prosecute and only requested a trespass warning.
I then approached the subject, later identified as Michael J Towers. I asked Towers if he had been trespassed from this Walmart. Towers admitted that he had been trespassed from Walmart, but he thought it was only for 1 year. Edwards requested that Towers
leave the store and be re-trespassed.
Dispatch conducted a wants and warrants check on Towers with negative results. Dispatch confirmed that a case number had been pulled on Towers for Trespassing. However, the trespass warning was missing from the internal system (Capilla).
Towers was re-issued a trespass warning per request of Edwards. I advised Towers that he would be arrested for criminal trespassing if he returned to Walmart, located at 8701 U.S. Highway 19 in Port Richey. I further advised Towers that the trespass waning was indefinite and it did not expire. Towers acknowledged, and signed the trespass warning before leaving the property.
I received, and he signed a copy of the trespass warning. I advised Edwards to contact the Port Richey Police Department if Towers returned.
