Danny, a man in the bar, offered to buy them both a drink and started socializing with the two women. In the bar people had to share and take turns with the pinball machine that was in the back and Danny’s turn had come up. He and Ms. Tobias went to the back to continue socializing while Danny played pinball. Soon a college-aged male joined the two of them and they continue drinking and added smoking marijuana to the mix. Soon a tune came from the jukebox and Sarah started dancing around and eventually she decided that she needed to start heading home. Danny attempted to stop her by forcing himself upon her and by pushing her on top of the pinball machine, with her crying out no. The driver of the truck was concerned of her condition and took her directly to the hospital. The physician that was caring for her questioned her as if she asked for the assault to take place. Kathryn Murphy came to the hospital to take Tobias’s statement.
Murphy went to her superior and told him the case wasn’t able to be won, that Ms. Tobias words were not believable. She didn’t think the rape was fake, quite the opposite, she just felt that due to the circumstances of Ms. Murphy’s background, life and even the clothes she wore to the bar would make convincing a jury impossible. Murphy offered a plea bargain of reckless endangerment instead of rape one charges, both carrying the same sentence, but the defendants would not have to register as sec offenders.
