Correctional areas such as probation and parole have also experienced privatization. Most of the states reasons for privatizing were due to staffing and resources were not keeping pace with increasing caseloads. Community supervision officials felt they have exhausted the use of interns and volunteers, and obtaining funding for new staff was not possible. As a result, some of the states partnered with the private sector to monitor the low-risk offender population, a group that generally has few needs, whose past records reflect little or no violence. These low-risk offenders successfully complete community supervision about 90 percent of the time (Alarid, 2015).

MS was sentenced at Rotherham Magistrates Court, for an offence of theft and was made subject to a twelve month Community Order under the Criminal Justice Act 2003. The following two requirements were imposed MS must attend Supervision to address his offending behaviour and an Alcohol Treatment Requirement to address his alcohol misuse. The reasons given behind this were that such a sentence would allow him to work with a Probation Officer in respect of the rehabilitation element. This proposal fits neatly with the anti-custody values of the Probation Service whose underlying concern is to deal with offenders in constructive ways which do not damage or degrade them. This is also related to other probation values of client self-determination and potential for change (Williams B 1995). Probation Orders are seen as punishments in themselves. Wasik and Taylor assert that the Criminal Justice Act 1991 introduced the Probation Order as a sentence of the court in its own right (Wasik and Taylor 1991 Pg48). Dunbar and Langdon argue that this Act was passed at a time when a major aim or criminal justice policy was to reduce prison numbers and ensure that sentences and the public saw community sentences as a viable option (Dunbar and Langdon 1998 Pg74).     First, we have the safety concern that critics bring up when the topic of private prisons is mentioned. Secondly, we have the dependency issue they bring up when talking about data relating to the industry’s growth in the last decade. Finally, we have the issue of keeping inmates locked up in order for the private prisons to make more money. Since private prisons are in the business of making money, they are always tempted to cut corners to turn a greater profit each quarter. They do this by hiring people who are not properly trained when compared to a staff member who is employed by a publicly prison ran by the state. In fact “private prison employees receive 58 hours less training than their publicly employed counterparts” (Mason). A nationwide study found that “assaults on guards by inmates were 49 percent more frequent in private prisons” (Smith). The study also saw that inmate-on-inmate assaults were “65 percent more frequent in private prison” (Smith). Given these statistics, those who are critics of private prisons have a valid reason for concern. These statistics allow for critics to show that there is a strong possibility that the lack of training given by private prisons. Leads to a higher risk of violence within the prison walls.
