In every state it is illegal for a paralegal to practice law, they are not attorneys. If Polly Paralegal contacts them and gives them legal advice she would be engaging in UPL because she would be acting as an attorney but she is not an attorney. The best thing for her to do is tell them she cannot give them legal advice because she is not an attorney but she can get the information and give it to her supervising attorney so he or she can help Mr. and Mrs. Smith with their divorce situation. In order to find out if Polly Paralegal would be engaging in UPL if she answers Mr. and Mrs. Smith you have to know what UPL is and the rules. UPL is short for unauthorized practice of law. UPL is basically when an attorney practices law where they are not licensed to and paralegals are not allowed to give legal advice. Attorneys can only practice law in the states where they are licensed. Paralegals…

Attorneys expect a lot from their paralegals, and the same can be said for the paralegals as well. A good attorney should be able to recognize the brains he/she has working for him/her as paralegals and reward them with more challenging work. By providing paralegals with interesting work, involvement with clients and cases, and good supervision, more firms and corporations have a greater chance of keeping those individuals working for them and even possibly have them further their education, such as possibly going to law…

    Paralegal Malpractice

    • 391 Words
    • 2 Pages

Sally can suggest that Molly talk to her (Sally’s) attorney that she works with and set up an appointment with them to talk to them and see what they can do about her problem with her doctor and her knee surgery. As Molly doesn’t have any money, Sally can help her by helping her find someone who does Pro-bono cases for malpractice. Sally can tell her whether or not she has a good case but she can’t really tell her what to do, where to go, or even what papers to file to start the case. If she were to tell Molly what to do, where to go, or even what papers to file to start the case she could get into serious trouble for UPL’s (un authorized practice of law). As a paralegal, Sally can’t establish client-attorney relationships, set legal fees, give opinions or advice that involve legal matters, or even represent Molly before the court with her case. These things listed are called UPL’s. If an attorney messes with the UPL’s the consequences could be being reprimanded, which is being firmly scolded. She could be suspended, which is temporarily being unable to practice as a paralegal for a short time. Sally could even be Disbarred, which means being unable to practice as a paralegal in any law firm forever. Sally could even be imprisoned for messing with the UPL’s. If sally were to become imprisoned, it could bar her chances of ever being able to get a job in any other field that she chooses. There is also a civil liability for negligence, and criminal liability.…

Sofia, I completely agree. That a paralegal’s average pay is reasonable based on the level of education needed to become one. I was quite intrigued to find out that paralegals in San Francisco make $70,000 annually. It seems like a lot of people believe paralegals should earn a higher salary. Because of the amount of work they do on a daily basis. I think that if we are truly passionate about the learning the law we won’t work a day if we obtain a position as a paralegal. Working under the supervision of an attorney will prepare anyone of us interested in going to law…

There are proven benefits of being a paralegal. First, the employment outlook is great because the demand for legal assistants is on the rise. Second, being a paralegal is an entry-level job that does not require the student to attend law school or pass a bar exam. Work engagement is key to organizational efforts to retain nurses and mitigate future nursing shortages. In their dual role as caregivers and organization “keepers,” nurses may already have the key to creating a culture of engagement. “The characteristics and benefits of “engaging” work environments are captured in nursing professional practice models, as evidenced by a quarter century of research on Magnet hospitals and professional practice.” (ANA 2004) An inflection point, providing an opportunity for transformational change in the nursing work environment, may be generated by a critical need for nurses and a call for healthcare delivery system redesign.…
