Eminent Domain: What’s important? What is more important in a neighborhood, a community, or a city- preserving the integrity and the way of life that many families have worked hard to establish and build or moving forward into the future in the name if modernization and progress? I believe that moving forward into the future in the name of modernization and progress is more important in a community, a neighborhood, and a city. Well thanks to eminent domain government has that power to modernize and beautify any city in their state. The benefits to eminent domain are limitless when government plays their cards right. However, it may also be taken for reasons of public safety. Often, governmental units, particularly at the local level, begin condemnation proceedings for private property that is not needed for public use, but rather, has been deemed a risk to the public health or safety. This, in fact, is the more appropriate use of the term "condemnation," although the authority or power invoked to condemn the property is that of eminent domain. As cities and towns expand and undertake improvements to roadways, sewer and power lines, communications, and other systems, the government must often secure or acquire access to private land. Without the government's power to do so, the size and capabilities of our public infrastructure would become inadequate to serve the needs of society. An aggrieved party who objects to a government taking must have an opportunity to receive fair notice, a reasonable time to obtain legal advice and prepare a formal objection. Additionally, there must be opportunity for a fair hearing before the award, of compensation, becomes final. An eminent domain action requires that the government's taking of property be for
