1. What is the difference between a. and a. Mr. Smith and his Mourning Routine Based on the unusual and panicked behavior that Mr. Smith’s presence caused in the group of students, there is enough reasonable suspicion for him to act upon. Slamming the locker and hurriedly dispersing, provides reasonable suspicion that the students were involved in an inappropriate activity. Although, Mr. Smith has reasonable suspicion of acting in this case, there are limits to the scope of his investigation. Mr. Smith would be justified in searching the locker, but based on the information presented, that may be the limitation of his search. The situation includes a first-hand account of a student’s observations of Johnny, which satisfies the reasonable suspicion standard. The claim that Johnny frequently uses marijuana before school, strengthens the suspicion, but must be used carefully since this is a generalized allegation. In this situation, all parts of the Nexus Connection are satisfied. There is a direct link to the school environment, through the allegation that Johnny possessed marijuana on school property, possession of an illegal substance is in clear violation of the student code of conduct, and drug use on campus is a risk to student safety and the safety of the overall learning environment. This satisfies all three components of the Nexus Connection (object – marijuana, infraction – possession of marijuana on school grounds, and place – on the student while on school grounds). As principal I would proceed with the following steps: first I would interview the student who brought the allegations against Johnny, then I would search Johnny’s backpack. Depending on the findings of the backpack search and if more reasonable suspicion is presented, I would subsequently search Johnny’s car with the possibility of involving law enforcement if needed. Finally, I would follow up with Johnny and his parents regarding disciplinary proceedings. Throughout every step, I would ensure the conversations and searches were properly
