Dear Susan,

You didn't attain the title of partner at Crowne by backing down from difficult challenges and dodging obstacles, and I'm certain you will apply the same cool headed and sound approach to problem solving to directly address this unfortunate situation with your client, Brian Hanson. Clearly, Brian's actions that evening were inappropriate and a violation of your right to not be harassed. But despite the fact that most everyone in your firm would publicly agree with this assessment, we both know that if news of this leaks out in an uncontrolled fashion, the ramifications could be personally devastating. As I see it, your ethical dilemma is deciding what steps need to be taken to maintain your position within Crowne, minimize impact to the Pellmore relationship, and reduce or eliminate the possibility that a similar incident can happen again to you or your female colleagues at Crowne. You may also want to consider how your approach to this situation could impact women's acceptance in consulting or even in other male dominated industries.

I contend that to do nothing would be a major mistake. From a Kantian perspective, it is your duty to take action to protect yourself and others from future advances. Staying silent is equivalent to allowing the situation to persist. Rule Utilitarianism also dictates immediate action by all victims of such harassment, as action by all reduces the potential cost incurred by individuals. Practically speaking, doing nothing also opens the door for Brian to take preemptive action by distorting the facts to protect

    I understand that they are old classmates and she helped him out, but the ethical thing to do was to cover themselves and Lydia. Penalties can be severe if violations are found. You can work hard all your life and work up a great reputation with your higher ups and build trust and just one mistake can erase all those years of hard work that you built.     I believe that our company stands to lose a lot as a result of a successful suit against us by Ms. Pollard. We have reason to believe that if these actions are taken to court, we will find it difficult to deny the allegations and defend ourselves in the lawsuit. Harassment is defined as a punishable offense, and is inappropriate and illegal for company workers, both management and the labor force, to participate in any behavior which is deemed harassing, threatening, demeaning or uncomfortable by the person who is claiming harassment. According to the Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act of 1967, (ADEA), and the Americans with Disabilities Act of 1990, (ADA), and the evidence presented by Ms. Pollard, our workers and management have clearly participated in violations of those orders. A simple defense on our part is to claim that there was no hostile work environment created, and that these incidents were few and far between, however, according to the law petty slights, annoyances and isolated incidents will not rise to the level of illegality, but I believe the amount of abuse that Ms. Pollard has taken, and can prove against us, is clearly enough to reasonably see how she can claim a hostile work environment.
