(B): Describe how two pieces of legislation impacts on the setting.

For this assignment, I will consider how rights and responsibilities of service users and service providers in the setting are impacted by the use of legislation.
According to www.dhsspsni.gov.uk “Legislation is defined as the act of making law(s) by the Governing Body in a country. Legislation is needed for the implementation of policies in, e.g. hospitals”
The two legislations I will consider are;
• The Northern Ireland Act 1998 (Section 75)
• The Children (NI) Order 1995

The Northern Ireland Act 1998

This legislation places a legal obligation on public authorities to include the promotion of equality in their daily work. It provides a legal framework to strengthen mainstreaming of equality and opportunity. It supports persons of different religious belief, racial group, age, promotes equality between men and women generally and between persons with and without a disability. Care providers have the responsibility to promote an inclusive environment within the chosen setting and to promote good relationships. The service users have the right to receive this equality from their care providers.

The Early year’s nursery ensures that service users are not discriminated against by offering classroom assistants for those needing more support e.g. due to a learning disability. This means that any service user who may be finding activities or work tasks difficult will be assisted and supported. The care providers have the responsibility to make sure all the staff adheres to this policy. This has an impact on the service providers as they are required to provide high quality care.
In addition, service users of all religions are enrolled within the play group. This illustrates that the nursery is non discriminative. No service user is refused entry to the nursery as this would be a breach of the legislation. The service users have the right to an education and equal opportunities
